Minimum Qualifications Promotion: one year of permanent competitive service as an Associate Director Human Resources 1 or 2.

There is currently no eligible list for this position, therefore, if no more than Three qualified individuals are interested, it will be possible to make a permanent appointment via non-competitive promotion.

Duties Description Work directly with DEC Executive management Counsel’s office to provide labor relations and safety & health expertise to align short – and long – term strategies to meet organization goals as identified by DEC leadership.

Directs and coordinates the implementation of the DECs employee safety and health program including statutory training for over 3,000 permanent and 1000 seasonal staff, the annual medical monitoring and immunizations of approximately 1,000 environmental quality and natural resources staff and the inspections of 300 DEC locations and safety audits of field operations.

Serves as the primary liaison to DEC for all Labor Relations matters. Directs the administration of the 5 Collective Bargaining Agreements (CBA) applicable to DEC. Drafts and/or advises on DEC policy development based on contractual changes. Advises DEC programs on all union related matters including interpreting contract articles, applying provisions of the contracts, responding/directing, as appropriate, in other areas.
NOTE: The Office handles approximately 40 disciplinary investigations and proceedings each year including insubordination and misconduct as a result of failure to comply with the Governor’s Covid-19 vaccination and testing mandates. Additionally, processes roughly 100 contract grievances, out-of-title work grievances and improper practice charges alleging violations of the Taylor Law.
Direct and maintain a professional and constructive organized program of dialogue with various labor unions. Act as the DEC management representative on various statewide and local labor/management and health and safety committees. Assist and advise the Governor's Office of Employee Relations and serve as a NYS management representative during statewide contract negotiations.
Provides direct oversight of the DEC COVID-19 pandemic response including managing the DEC COVID-19 response team responsible for contract tracking, issuance of precautionary quarantines and interfacing with the NYS and County Health Departments on COVID related matters. Advises DEC Executive on statewide COVID related policy development and implementation. Responsible for enforcing the Governor’s COVID Vaccination and Testing mandates as they apply to the DEC workforce through the labor union engagement and employee counseling and discipline processes.

Coordinates investigations alleging DEC personnel misconduct including the enforcement of administrative actions required by the Governor's Office of Employee Relations Anti-Discrimination Investigation Division

For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.
