Job Specifics
Minimum Qualifications One year of permanent competitive service in this title or in a title eligible transfer under Section 52.6 of the Civil Service Law.

Admission to the New York State Bar and current registration to practice law in New York State is required for continued employment. Disbarment or loss of registration shall result in termination or suspension of employment.
Duties Description • The Senior Attorney will represent OCFS in family court proceedings involving youth in OCFS custody including extensions of placement; in administrative proceedings including emergency Fenner transfers involving youth in OCFS custody and in child care enforcement hearings.
• Provide legal support to the Attorney General’s Office in conducting defensive litigation involving OCFS officials and employees; and review requested transfers to the New York State Department of Corrections and Community Supervision (DOCCS).
• Assist or personally prepare and present arguments at judicial and administrative proceedings and prepare findings, orders or decisions.
• Analyze and summarize cases and information pertinent to constitutional provisions, statutes, rules, regulations, policies and opinions and plan litigation strategy.
• Prepare for Judicial and administrative proceedings by reviewing cases, discussing strategy, coordinating investigations, examining case folders, conferring with program officials, preparing legal memoranda and issuing subpoenas.
• Try cases at proceedings by preparing opening statements and summations, arguing motions, examining witnesses, consulting with parties to the proceeding, examining evidence, preparing briefs, negotiating settlement, preparing appeals and advising superiors.
• Conduct legal research of statutes, decisions, opinions and other legal sources in order to respond, both orally and in writing, to requests for legal decisions and opinions.
• Interpret pertinent laws, rules, regulations, procedures, and policies; Evaluate and negotiate settlements.
• Determine violations of laws, rules, and regulations by child care providers and prepare appropriate legal documents to enforce laws, rules, and regulations.
Additional duties will be discussed during the interview.
Additional Comments The Senior Attorney must be admitted to practice in NYS and have experience in litigation and or administrative proceedings. This person needs to be able to travel up to 40% each week to all areas of NYS. A valid NYS driver’s license is required.
If you are on the Legal Specialties eligible list you may receive a canvass letter. Candidates must have 24 months of satisfactory legal experience for appointment to the Senior Attorney position.
