Job Specifics
Minimum Qualifications In order to be considered for appointment, candidates must be reachable on the current Civil Service eligible list or be eligible for reassignment or transfer in accordance with Civil Service Law.
Duties Description The selected candidate will perform the following duties:
• Research and analyze legal issues, statutes, case law, opinions, briefs and other material for use in preparation of recommendations and memoranda of law, contracts, agreements and legislation. Respond, both orally and in writing, to requests for legal decisions and opinions. Topics to be handled, include, but are not limited to issues involving Transportation Law, Highway Law, Vehicle and Traffic Law, Public Officers Law, Finance Law, Executive Law, highway construction and maintenance, Federal Highway Administration, traffic safety, highway beautification and environmental matters. Interpret pertinent laws, rules, regulations, procedures, etc. for compliance and enforcement issues.
• Independently plan, organize and conduct reviews and analysis of day-to-day agency legal problems, cases and legislative proposals. Confer with Department personnel or outside parties to address legal issues related to the Department’s activities and services. Participate in conferences and meetings in order to exchange specific information regarding agency actions and the legal basis for such actions. Advise Department personnel regarding the legality of actions or determinations and may, as appropriate, suggest changes to conform to legal requirements. Provide litigation support to the Office of the Attorney General handling litigation on behalf of the Department.
• Provide general legal advice and assistance to Department personnel and others as may be necessary in connection with the activities and services provided by the Department. Review, comment on and approve bulletins, forms, pamphlets, etc., related to the legal aspects of agency activities.
• Negotiate, prepare and review various legal documents, including but not limited to, contracts, agreements and leases. Possess related familiarity with related contract requirements. Review and analyze documents for legal sufficiency. Meet with those concerned to obtain information, answer questions and resolve problems.
• Review and determine small claim matters by gathering information.
Responsibilities may include serving a role within the Incident Command System to support the department’s response to regional and statewide emergency situations.
