Job Specifics
Minimum Qualifications Legal Assistant/Legal Assistant Trainee:
Interested candidates must be reachable on the Legal Assistant 1 eligible list or Legal Assistant Trainee eligible list; or eligible to transfer under section 70.1 of the Civil Service Law.
To be eligible to transfer to Legal Assistant:
NYS employees must have at least one year of permanent competitive service in an appropriate SG-12 or higher title and possession of an associate's degree or certificate in legal studies, paralegal studies, or legal assistant studies from an accredited institution or one approved by the American Bar Association, and meet transfer eligibility requirements.
To be eligible to transfer to Legal Assistant Trainee 1:
NYS employees must have at least one year of permanent competitive service in an appropriate SG-11 or higher title and possession of an associate's degree or certificate in legal studies, paralegal studies, or legal assistant studies from an accredited institution or one approved by the American Bar Association, and meet transfer eligibility requirements.
Trainees will be required to successfully complete six courses in paralegal studies and related skills from an accredited college or university. Also, in addition, one or more college or training courses in writing skills will be required in addition to on-the-job-training activities.
Duties Description Litigation Referral and Collection Support.
• Request Investigative Summary Reports (ISRs) from DEC for cases eligible for collection or identified by Senior Attorney.
• Handle intake of ISRs from DEC and prepare and organize them for the Senior Attorney.
• As assigned by Senior Attorney, engage in direct collection efforts with insurance companies and other misc. collections.
• Prepare and keep updated all settlement discussion notes and related material of Senior Attorney related to the Fund’s 1500 open cases.
• Handle all case closing letters submitted by the attorney general’s office and do preliminary review as to whether matter can be closed or unpaid funds written off whether for statute of limitations, legal proof or bankruptcy/inability to pay issues.
• Maintain litigation tracking system and reconcile monthly with the attorney general’s office.
• Obtain accident reports, probation reports and court decrees as necessary from State Police authorities, DEC regional offices and district attorney offices when needed to strengthen the existing support for cases to be referred to the attorney general’s office for litigation/collection.
• Review and provide discovery documents as requested by attorney general’s office or Senior Attorney for ongoing cases.
Legal Document Review, Processing and Legal Research.
• Legal research of court decisions or orders.
• Shepardizing cases.
• Tracking legislation that impacts the Fund.
• Performing preliminary research related to drafting of Fund Regulations and DEC regulations in the Oil Spill Program.
• Drafting letters to public that implicate existing Fund legal cases including some executive correspondence.
• Reviewing affidavits prepared by attorney general’s office for legal sufficiency before they are signed by Fund Managers.
• Reviewing and processing foreclosure and bankruptcy notices served on the Fund.
Environmental Lien Processing.
• Assist the Senior Attorney in the processing and filing of liens including reviewing deeds and
• Other title work to ensure proper parties and lots are being liened, drafting liens and release
• Documents, following up with attorney general’s office, OSC counsel’s office and county clerks’
• Offices as necessary. Bringing more complex issues and problems related to the liens to the
• Attention of Senior Attorney.
Damage Claim Support.
• Provide initial preliminary review of Third Party Damage Claims filed with Fund, including following up with DEC, AG and claimants or their attorneys as necessary.
• Draft Legal Notices as part of administrative process as directed by Legal Assistant 2 or Senior Attorney.
• Attend hearings or claim settlement meetings as support for Senior Attorney.
Additional Comments EDUCATION:
• Associate’s degree or certificate in legal studies, paralegal studies, or legal assistant studies from an accredited institution or one approved by the American Bar Association,
PREFERRED COMPETENCIES:
• Associates Degree in paralegal studies supplemented by a four year degree preferred.
• Experience with litigation or real property or collection law desired.
• Proficient in excel and access applications.
• Experience dealing with the public in any field.
