Job Specifics

Minimum Qualifications Admission to the New York State Bar and a member in good standing with seven (7) years post-bar admission experience as a prosecutor. Commitment to public service and excellent research/writing skills are essential. NYS residency required.

*The preferred candidate will have five (5) or more years of work handling appellate matters, including oral argument before the Appellate Division(s) and/or Court of Appeals.

* Salary commensurate with experience.

Duties Description Serve as an Appellate Assistant Special Prosecutor in the Office of the Special Prosecutor/Inspector General and perform the following functions, including but not limited to:
• Conduct criminal appeals on prosecutions including research and writing of People’s filings and oral argument before the courts of New York State.
• Appear on matters in local criminal courts.
• Advise and assist assigned Assistant Special Prosecutors with motion practice in reviewing possible appellate issues from charging decisions to all aspects of criminal proceedings; draft and argue motions on legal issues on all aspects of criminal proceedings; review Grand Jury presentations and indictments.
• Work closely with local district attorneys’ offices to advise and confer on matters that fall within each jurisdictional authority. Advise on charging considerations and collateral consequences unique to cases associated with calls of abuse and neglect made to the NYS Justice Center’s central register.
• Consult and advise NYS Justice Center’s investigators on pending investigations.
• Participate in local and statewide committees related to appellate work; prepare legal updates and memorandum for all staff in the Office of the Special Prosecutor/Inspector General.
• Appear on behalf of the agency at administrative proceedings, to defend subject substantiations under the Protections of People With Special Needs Act.

Additional Comments The New York State Justice Center for the Protection of People with Special Needs (Justice Center) is charged with protecting over one million New Yorkers under the care or jurisdiction of six state agencies. The following list outlines several of the Justice Center’s key responsibilities:
• Advocate on behalf of individuals with disabilities and provide oversight of quality of care.
• Operate a centralized, statewide 24-hour hotline and incident reporting system staffed by trained personnel.
• Operate a statewide register that contains the names of individuals found responsible for egregious or repeated acts of abuse or neglect.
• Centralize and perform functions relating to criminal history background checks.
• Investigate serious allegations of abuse and neglect.
• Prosecute criminal acts of abuse and neglect.
• Analyze abuse patterns and trends in order to prevent future occurrences.

Position eligible for $3026 annual location pay factor.
