Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must have been admitted to the New York State bar and have at least three years of progressively responsible post-graduate legal experience. Excellent analytical, writing and communication skills and knowledge of education law, contracts and/or labor relations are preferred.

Duties Description The New York State Education Department is looking to fill an Assistant Counsel position in the Office of Higher Education in the area of Teacher and Leader Effectiveness. The incumbent of this position will provide oral and written legal advice and services to SED staff on issues relating to teacher and leader effectiveness. The incumbent will also be responsible for overseeing the legal review of Annual Professional Performance Reviews (APPR) and Teacher/Leader agreements submitted by districts based on Education Law §3012-c and applicable regulations. Duties of this position will include, but are not limited to:

• Working with a team of specialists in the operation and management of the process for establishing and reviewing APPRs and Teacher/Leader agreements submitted by districts based on Education Law §3012-c and applicable regulations;
• Overseeing legal review and providing legal advice and counsel on issues regarding APPR compliance with applicable State laws and regulations;
• Providing legal advice and counsel to SED staff and managers on issues related to teacher and leader effectiveness, including APPRs, as well as other areas of Race to the Top that are related to teacher and leader effectiveness; and
• Assisting SED’s Office of Counsel on issues relating to teacher and principal evaluations and APPRs in administrative appeals, litigation, legislation and regulations.

Additional Comments CONDITIONS OF EMPLOYMENT: This will be an exempt appointment. Filling of this position is contingent on Division of Budget approval.
