Minimum Qualifications Candidates must have one year of permanent competitive or 55b/c service as a Senior Attorney -OR- one year of permanent competitive or 55b/b service in a title eligible for transfer under Section 52.6 or 70.1 of the Civil Service Law. Qualified candidates must hold a Juris Doctorate degree and be admitted to the Bar to practice law in New York State.
Duties Description Incumbent will be a Senior Attorney in the Office of General Counsel primarily assigned to the Administrative Review Division. The Senior Attorney will be primarily responsible for reviewing applications for administrative review submitted pursuant to WCL Section 23 and drafting proposed decisions related to those applications for approval by Members of the Workers' Compensation Board. Such review and drafting will require articulating the issue(s) raised on appeal, reviewing documents in the Board's files, ascertaining the facts, performing legal research, applying the law to the facts, and proposing a resolution in a proposed decision following a standardized format. The Senior Attorney will also prepare revised decisions after Oral Argument and when the Board Panel recommends technical corrections, amendments or rescissions of the proposed decision. The incumbent may also be tasked with assisting the Legal Affairs or Litigation Unit as necessary. Upon occasion the incumbent may also be involved in special legal projects on various issues concerning the application of Workers' Compensation Law, give presentations, Continuing Legal Education lectures, legal summaries, etc.
