Minimum Qualifications Candidates must have one year of permanent competitive or 55b/c service as a Senior Attorney -OR- one year of permanent competitive or 55b/b service in a title eligible for transfer under Section 52.6 or 70.1 of the Civil Service Law. Qualified candidates must hold a Juris Doctorate degree and be admitted to the Bar to practice law in New York State.
Duties Description Incumbent will perform legal research and writing necessary to address issues raised by agency executive and non-executive staff involved in operations, adjudication, compliance, Board Members, other governmental entities and constituents of the workers’ compensation system outside the agency; review applications for full board review; review notices of appeal to the New York State Appellate Division submitted pursuant to Workers’ Compensation Law Section 23, and drafting proposed decisions related to those applications for approval by Members of the Workers' Compensation Board. Such review and drafting will require articulating the issues raised on appeal, reviewing documents in the Board's files, ascertaining the facts, performing legal research, applying the law to the facts, and proposing a resolution in a proposed decision following a standardized format. Upon occasion, incumbent may be involved in special legal projects regarding legislation, regulations, and various legal issues concerning the application of Workers' Compensation Law. In addition, the incumbent will give presentations and Continuing Legal Education lectures, prepare legal opinions and briefs and be prepared to defend them as needed, and represent the Board with respect to investigations, depositions, interrogations, and informal (non-hearing) and formal (hearing) proceedings in relation to Board authorized health care providers/entities, etc.
