Minimum Qualifications Must be reachable on the current Civil Service eligible list or be eligible for 70.1 transfer. In order to qualify for a Section 70.1 transfer, candidates must have one year of permanent service in a Grade 12 or higher level title. The title cannot be a second consecutive transfer resulting in an advancement of more than two grade levels. Some titles eligible for a 70.1 transfer are Administrative Aide, Agency program Aide, Principal Clerk or Principal Clerk Personnel, etc. NOTE: Special Credential is required for the Legal Assistant 1 in order to qualify for 70.1 transfer. Candidate must have an associate degree or certificate in legal studies, paralegal studies, or legal assistant studies from an accredited institution or one approved by the American Bar Association.

Duties Description The Office of the Counsel provides legal guidance and services to the Office for People With Developmental Disabilities (OPWDD) network on a myriad of issues arising from the delivery of supports and services to individuals with developmental disabilities. These positions will provide paralegal support for the Deputy Counsel for OPWDD Litigation Unit and the Deputy Counsel for OPWDD Fair Hearings Unit. Under the supervision of the Legal Assistant 2 the duties and responsibilities include, but are not limited to the following:

• Gather and organize documents with respect to due process hearings brought by individuals or families;
• Assist attorneys and agency staff in preparation for administrative hearings;
• Draft hearing summaries and identify and assemble exhibits for hearings;
• Maintain, organize and oversee litigation and fair hearing files;
• Track compliance with all due dates, process and respond to document subpoenas;
• Assist with investigations;
• Track compliance with the internal discrimination process;
• Prepare opinions on routine matters;
• Review case related material for line of questioning;
• Schedule witnesses, take disposition and collect information relevant to a case.

Additional Comments (Three positions available: Appointments can also be made at the Trainee 1 level and serve up to a two year traineeship)

All OPWDD employees must be eligible and maintain eligibility for full and unconditional participation in the Medicare and Medicaid programs. Continued employment will depend on maintaining eligibility.
