Minimum Qualifications Admission to practice before New York courts; experience in the labor and employment law fields; litigation experience including having tried jury, non-jury, arbitration and/or administrative hearing cases. Excellent writing skills.
Duties Description The Office of the Counsel provides legal guidance and services to the Office for People With Developmental Disabilities (OPWDD) network on a myriad of issues arising from the delivery of supports and services to individuals with developmental disabilities. Attorneys are called upon to: draft and review legislation, regulations, contracts, and real property transactions; provide advice on employment matters; provide representation in administrative hearings; and oversee and assist with litigation. This position will report directly to the Deputy Counsel and Head of the Litigation and Human Resources Bureau within OPWDD’s Counsel’s Office.
PRIMARY DUTIES AND RESPONSIBILITIES:
• Defend the agency before the Division of Human Rights and the Equal Employment Opportunity Commission with respect to discrimination complaints and charges, and before the Workers Compensation Board on discrimination claims, as well as in other administrative hearings;
• Prepare HR policies and practices and review and comment on proposed laws and regulations;
• Provide counsel regarding labor relations including with respect to disciplinary matters and charges and motions for court ordered subpoenas in disciplinary cases. Prepare memorandums of law regarding arbitration issues;
• Investigate lawsuits and claims as well as CPLR Article 75 and Article 78 proceedings against the agency and support the Attorney General’s Office in its defense of the agency including assisting with preparation of pleadings, memorandums of law and motion affidavits. Issue litigation holds to preserve evidence. Defend non-party employee depositions. Handle and respond to subpoenas. Assist the Attorney General’s Office with discovery, and deposition and trial arrangements.

• Provide advice to Counsel’s Office attorneys and agency employees on human resources matters including, but not limited to terminations, reasonable accommodations, civil service law, discipline, religious accommodations, disability leaves, workers compensation, medical examinations, hiring, confidentiality of documents, FMLA and USERRA.
Additional Comments All OPWDD employees must be eligible and maintain eligibility for full and unconditional participation in the Medicare and Medicaid programs. Continued Employment will depend on maintaining eligibility.
