Minimum Qualifications Admission to the New York State Bar and a member in good standing with three (3) years post-admission experience as a criminal prosecutor or criminal defense attorney before the Courts of New York State. Commitment to public service and excellent research/writing skills are essential. NYS residency is required.
* The preferred candidate will have two (2) or more years of work with special victims, sex crimes, child abuse or domestic violence are preferred.
Duties Description The Assistant Counsel would serve as an Assistant Special Prosecutor in the Office of the Special Prosecutor/Inspector General and perform the following functions, including but not limited to:
• Review criminal investigations and make preliminary recommendations on appropriate criminal charges. Under supervision, draft charging documents, gather documentation, prepare witnesses to prosecute cases of abuse and neglect against vulnerable persons in New York State. Appear on criminal matters in local, county and supreme courts throughout the state. Prepare Grand Jury presentations and indict criminal defendants. Conduct criminal hearings and trials.
• Work closely with local district attorneys’ offices regarding cases being prosecuted by the local DA. Advise on charging considerations and collateral consequences unique to cases associated with calls of abuse and neglect made to the Justice Center’s hotline.
• Consult and advise Justice Center’s criminal and non-criminal investigators on pending investigations and make recommendations regarding substantiation of cases. Interview witnesses, including vulnerable persons to advise on the appropriate course of action for pending investigations.
• Participate in local and statewide task forces and organizations related to the criminal prosecution of persons charged with abuse or neglect of vulnerable New Yorkers.
• Conduct training on legal issues to law enforcement, prosecutors and advocacy organizations.
• Travel is required up to 40 % of time. This position is based in Delmar.
Additional Comments Additional Comments: As required by the Protection of People with Special Needs Act, the New York State Justice Center for the Protection of People with Special Needs (Justice Center) has been operational since June 30, 2013. This new agency is helping to transform how New York State protects over one million New Yorkers under the care or jurisdiction of six state agencies. The following list outlines several of the Justice Center’s key responsibilities:
• Advocate on behalf of individuals with disabilities and provide oversight of quality of care.
• Operate a centralized, statewide 24-hour hotline and incident reporting system staffed by trained personnel.
• Operate a statewide register that contains the names of individuals found responsible for egregious or repeated acts of abuse or neglect.
• Centralize and perform functions relating to criminal history background checks.
• Investigate serious allegations of abuse and neglect.
• Conduct administrative reviews regarding appeals of substantiated charges of abuse or neglect.
• Prosecute criminal acts of abuse and neglect.
• Analyze abuse patterns and trends in order to prevent future occurrences.
