PREFERRED QUALIFICATIONS:
Must be an attorney admitted to practice in New York State with experience in administrative law and/or health or disabilities law. Experience in FOIL, privacy issues, State procurement law, and policy analysis is desirable.
Duties Description The Office of Counsel provides legal guidance and services to the Office for People With Developmental Disabilities (OPWDD) service network on the myriad of issues arising from the delivery of supports and services to individuals with developmental disabilities. This position will report to the Deputy Counsel for Policy and Regulatory Affairs. The Bureau of Policy and Regulatory Affairs oversees the preparation of the agency’s legislative agenda, regulations, Administrative Directive Memoranda (ADMs), and policies and is responsible for filing all new OPWDD regulations in accordance with the requirements of the State Administrative Procedure Act. The Bureau also supervises agency compliance with agency confidentiality and health privacy rules, ethics, and Freedom of Information Law (FOIL) requests.
The Senior Attorney will perform the following duties:
• Act as the agency’s Records Access Officer; review requests under the Freedom of Information Law (FOIL) and Personal Privacy Protection Law (PPPL) and render determination consistent with the State FOIL statute and related requirements, supervise gathering and review of documents, redactions, and recordkeeping;
• Review various kinds of requests for agency documents and information relating to program participants, determining the extend of disclosure permissible under the complex construct of confidentiality requirements applicable to the agency’s regulatory environment;
• Assist in review of the agency’s HIPAA compliance program, including periodic gap analyses and risk assessments, review and amendment of policies and operating procedures. Assist in training and implementation of revised procedures to be implemented through the agency’s regional offices, work in close partnership with other agency program and administrative divisions to develop compliance strategies and measurements to ensure compliance with HIPAA and other information security requirements on a proactive basis;
• Assist in ensuring agency compliance with information security and related confidentiality requirements related to the agency’s provision of services, assist in investigation and mitigation of information security incidents and assist in implementation of mitigation as necessary, assist in review of the agency’s information security program, including review and amendment of policies and procedures as necessary;
• Assist in review of agency’s purchasing and procurement practices and development of policy and compliance strategies, with an emphasis on internal controls and related regulatory issues.
Additional Comments All OPWDD employees must be eligible and maintain eligibility for full and unconditional participation in the Medicare and Medicaid programs. Continued employment will depend on maintaining eligibility.
