Minimum Qualifications This is a transfer opportunity for a current NYS employee who has permanent status as a Senior Attorney.

One year of permanent competitive or 55b/c service as a Senior Attorney Realty, SG-25.

52.6 Transfer:
One year of permanent competitive or 55b/c service in a position at the SG-23 level or above designated administrative pursuant to Section 52.6 of the Civil Service Law.

Duties Description Under the general direction of the Counsel for the New York State Office for the Aging (NYSOFA), a significant portion of the Senior Attorney’s duties will include working with agency staff to develop, amend and promulgate regulations and program standards for programs administered by the Office under the Older Americans Act and the Elder Law. Other responsibilities will include serving as the Agency’s Compliance Officer under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Personal Privacy Protection Law Officer under the New York State Personal Privacy Protection Law. The Senior Attorney will also be involved in drafting and reviewing contracts, grants, interagency agreements, including data use agreements, and ensuring the appropriateness and legal sufficiency of these documents. The Senior Attorney will assist fiscal and program staff with legal issues relating to procurement, contracting and the Annual Implementation Plans submitted to NYSOFA by the area agencies on aging, pursuant to the Older Americans Act.
It is anticipated that this position will require approximately 5% travel, including some overnight.
SPECIFIC DUTIES: (Illustrative only)
• Develop, amend and promulgate appropriate regulations and program standards for programs administered by NYSOFA.
• Serve as the Agency’s HIPAA Compliance Officer and Personal Privacy Protection Law Officer.
• Advise the Counsel on matters relating to law and the legal implications of policies and procedures established and/or used by NYSOFA.
• Assist the staff of NYSOFA and local grantees in interpreting legal matters related to the administration of programs by the Office under the provisions of the federal Older Americans Act, the NYS Elder Law and various other programs.
• Provide analyses and interpretations of federal, state and local legislation affecting programs and services for older adults.
• Draft and review contracts, grants and interagency agreements, including data use agreements, and ensure the appropriateness and legal sufficiency of these documents.
• Assist with the development of Requests for Application, Requests for Proposal and grant applications.
• Review the Annual Implementation Plans submitted for approval to NYSOFA by the area agencies on aging for appropriateness and legal sufficiency.
• Assist fiscal and program staff with legal issues related to procurement, contracting and the Annual Implementation Plans.
• Perform other tasks as assigned by the Counsel.
