Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must have one year of permanent competitive service as an Agency Labor Relations Representative 1 OR have one year of permanent competitive service in a title SG-21 or above deemed eligible to transfer under Section 52.6 of the Civil Service Law OR be reachable on the Agency Labor Relations Representative 1 eligible list.

Duties Description The New York State Education Department (NYSED) is seeking to fill two (2) Agency Labor Relations Representative 1 positions in the Office of Human Resources Management (OHRM). OHRM provides personnel services, staff development, labor relations and employee benefits to staff in various diverse program areas within the Education Department, including the Office of P-12 Education; the Office of Adult Career and Continuing Education Services; the Office of the Professions; the Office of Cultural Education; the Office of Higher Education; the Office of Performance Improvement and Management Services; the Office of the Chief Financial Officer; and the two State run schools at Rome and Batavia. Under the direction of an Agency Labor Relations Representative 3, the incumbent of this position will assist in the administration and maintenance of the labor relations program, including administering employee discipline and grievance procedures, participate in labor management meetings and provide technical assistance to employees and managers in implementing the negotiated contracts while maintaining effective labor relations. The duties of this position will include, but not be limited to, the following:

• Advise supervisors and managers regarding meeting the terms and conditions of employment as it pertains and relates to negotiated agreements;
• Meet with local union representatives to informally resolve grievances and labor relations problems before they become subjects of formal grievance actions;
• Advise supervisory staff on review and response to first step grievances, ensuring that all grievances are promptly and fairly addressed;
• Investigate second step contract grievances and contract grievance appeals and serve as a second management reviewer and issue decisions;
• Develop and maintain an ongoing dialogue with employee representatives, including participating in labor management committees;
• Assist management and supervisory staff in the investigation and preparation of disciplinary charges, including the conduct of interrogations;
• Advise supervisors and managers on disciplinary procedures and prepare Notices of Discipline;
• As assigned, represents the Department at disciplinary arbitrations;
• Respond to inquiries regarding Department policies and activities from representatives of the employee organizations; and
• Provide training on labor relations to all Department staff.

Additional Comments CONDITIONS OF EMPLOYMENT: Both positions will be permanent appointments. Filling of these positions are contingent upon Division of Budget approval.
