Minimum Qualifications Admission to the New York State Bar and two years of post-Bar legal experience in the trial of issues in courts of records or trials of adversarial proceedings, quasi-judicial in nature, before a government agency.

The preferred candidate must have a reputation for ethical behavior, have the ability to gather information and determine its relevance in making written findings of fact based on the evidence, exercise excellent critical-thinking skills and high-level reading and writing abilities. Successful candidate must be impartial and present a calm, neutral, and business-like demeanor.

The incumbent to the position would work part-time on a per diem basis as the workload of the Office dictates.

Duties Description Under the general direction of the Supervising Administrative Law Judge for the Office of Administrative Hearings, the incumbent would be required to hear routine cases generated from the Department of State’s Division of Licensing Service. The Division of Licensing Services oversees the licensure, registration and regulation of 32 occupations throughout the state including real estate brokers/salespersons, cosmetology, appearance enhancement businesses, notary public and security guards.

The incumbent would conduct fair and impartial hearings, review hearing requests to determine probable issues and apply the appropriate regulations and sections of law, issue, or cause to be issued, subpoenas for the attendance of witnesses and production of necessary books, records and other documents, conduct hearings to review and decide appeals from agency determinations in regards to denial of licensing application or disciplinary actions against licensed entities, administer oaths and affirmations, elicit testimony from parties relative to the issues of the hearing and question witnesses to obtain facts, rule on various issues including objections by parties, relevancy and admissibility of evidence and exhibits and requests for adjournment, apply appropriate laws, regulations and policy to the facts and evidence, decide the issues being adjudicated as authorized by the applicable statute or rule and draft written opinions and decisions recommending license approval, denial or revocation or compromise settlements or penalties.

Additional Comments Hearing Officers are compensated $285.00 per day. Applicants will be fingerprinted and must submit to a background check that includes a review of criminal history and financial records.
