Minimum Qualifications Non-Competitive: Eight years of experience in the planning, development, implementation, and review of programs dealing with equal employment opportunity, human rights, affirmative action, minority business program coordination, affirmative action compliance review, labor relations directly relating to affirmative action, or in the development and administration of programs directly related to minority community access to employment or business opportunities in the public and private sector. Two years of this experience must have been in a management or supervisory capacity. Graduate and undergraduate credits may be substituted for experience, on the basis of 30 credit hours for each six months of experience.

Promotion: One year of experience as a Compliance Specialist 3, SG-25, or two years of experience as a Compliance Specialist 2, SG-23 or as a Minority Business Specialist 2, SG-23

Duties Description Under the general direction of the Assistant Commissioner the incumbent is responsible for compliance with the provisions of Article 15-A of the Executive Law, the rules and regulations contained within 5 NYCRR Parts 140-144, and the Business Diversification Act of 2010. This includes review and establishment of minority and women-owned utilization goals on design and construction, professional, and centralized contract and monitoring of contracts to ensure that contractors are in compliance. Additionally, the incumbent plans and executes targeted outreach events as part of the community relations responsibilities.

Specific duties include the following:

• Supervise compliance staff by assigning and monitoring staff work, identifying training and development activities and performing various related supervisory and administrative tasks.
• Ensure compliance staff research and respond to correspondence received from contractors, subcontractors, legislators and the executive office in a timely manner.
• Collaborate with agency executives to plan, develop and coordinate outreach activities focused on MWBE audiences.
• Review and analyze state and federal legislation, and prepare policy discussion papers and position papers on such issues.
• Review legislation to determine consistency with policies.
• In conjunction with Counsel’s office, draft appropriate MWBE language for inclusion into all contracts in response to legislation and rules and regulations promulgated by Empire State Development.
• Keep current on issues related to Affirmative Action and Minority and Women-owned Business Enterprises and advise management on the ramifications of such matters.
• Disseminate policy decisions to line managers and maintain those decision files.
• Review and update office’s policies and procedures manual, as necessary.
• Assist other OGS program units with developing solicitations and contracts that insure the maximum participation of MWBE in state procurement activities.
• Perform other assignments such as drafting briefing documents, quarterly reports to the Governor and reports to ESD on agency MWBE utilization, and updating of Annual MWBE Utilization Goal Plan.
• Participate in other special projects or assignments, as necessary.

The ideal candidate will possess excellent interpersonal, writing, oral communication and presentation skills. Must be able to work well with a diverse group of people and be an effective team player. NYS public sector experience preferred. This position will require travel across the state.
