Minimum Qualifications MINIMUM QUALIFICATIONS: For permanent appointment or reassignment for NYSED employees, candidates must have one year of permanent competitive or 55b/c service as an Agency Labor Relations Representative 2 OR candidates must be reachable on the appropriate Civil Service eligible list or a current NYS employee eligible for transfer under Section 52.6 of the Civil Service Law.
52.6 Transfer
To be eligible for transfer under Section 52.6, candidates must have one year of permanent competitive service in a 52.6 title allocated to grade 23 or higher.

PREFERRED QUALIFICATIONS: Special consideration will be given to candidates who meet the minimum qualifications and also possess the following: Two years of documented supervisory experience at the professional level and at least two years of experience serving as the primary State agency representative in disciplinary arbitrations and administrative hearings related to the NYS Civil Service Law.

Duties Description The New York State Education Department (NYSED) is seeking to fill the position of Agency Labor Relations Representative (ALRR) 2 in the Office of Human Resources Management (OHRM). OHRM provides personnel, staff development, labor relations and employee benefits services to staff in various program areas within the Education Department, including the: Office of P-12 Education; Office of Adult Career and Continuing Education Services; Office of the Professions; Office of Cultural Education; Office of Higher Education; Office of Performance Improvement and Management Services; Office of the Chief Financial Officer; and two schools operated by NYSED in Rome and Batavia. Under the direction of the ALRR 3, the ALRR 2 will assist in the development, management and coordination of the labor relations program within NYSED. The duties of this position include, but are not limited to, the following:

• Supervise and assign work to subordinate staff, adjusting staff workloads as needed;
• Monitor and review completed work and serve as a mentor and trainer to subordinate staff;
• Administer advanced employee discipline for all cases in which the penalty of termination has been requested;
• Investigate and process complex employee grievances;
• Investigate allegations of sexual harassment;
• Conduct all investigations in which physical assault or neglect has been alleged, including cases referred by the Justice Center;
• Research and provide complex technical advice to NYSED directors and program managers regarding the implementation of negotiated contracts;
• Represent the Department’s interests at all disciplinary hearings in which termination has been requested and all hearings conducted pursuant to the NYS Civil Service law;
• Assist counsel at hearings involving NYSED staff pursuant to the NYS Human Rights Law and participate in all investigation meetings conducted by the NYS Division of Human Rights;
• Develop training and reference materials on labor relations topics;
• Directly provide advice, as well as formal training, to Department managers on employee relations topics; and
• Represent the Department at agency-level labor/management committee meetings when the Director of Labor Relations is not available.

Additional Comments CONDITIONS OF EMPLOYMENT: This will be a permanent appointment. Filling of this position is contingent upon Division of Budget approval.
