Minimum Qualifications Preferred Qualifications: The preferred candidate will have at least 3 years of post-bar legal experience with knowledge of and experience with consumer protection laws and litigation or prosecutorial experience that includes work on investigations, discovery experience in complex litigation, and demonstrated ability to efficiently manage a large workload. The candidate should also possess excellent oral and written communication skills, research and analytical skills, and organizational skills.

Duties Description The Department of Financial Services is seeking candidates to fill the position of Associate Counsel, NS in its Financial Frauds & Consumer Protection Division (FFCPD). Under the supervision of the Executive Deputy Superintendent, the Associate Counsel’s duties may include, but not be limited to, the following:

• Work on investigations of potential violations of the Insurance, Banking, Financial Services Laws and other state and federal laws, including requesting and reviewing document productions, negotiating discovery disputes, taking testimony, negotiating settlement with opposing counsel, and preparing for and conducting administrative hearings and litigation.

• Analyze and evaluate evidence, identify law violations, and propose monetary penalties, restitution, injunctive relief, and/or referral for prosecution

• Propose and develop new areas and subjects for investigation.

• Assist in the review and amendment of insurance and banking laws and regulations, identifying law violations and emerging frauds trends.

• Assist in the review of proposed legislation and regulations and the implementation of passed legislation and adopted regulations.

• Provide legal advice on matters regarding regulatory actions and develop legal approaches to accomplish various departmental objectives.

• Assist in investigating complaints filed with the Department by consumers and consumer groups and recommend appropriate action.

• Review, clarify and interpret policy issues submitted by other Divisions, Bureaus, and operating units, highlighting key points for the Executive Deputy Superintendent’s review and recommending appropriate action.

• Assist with the development of and provide ongoing review of information contained in the FFCPD section of the Department of Financial Services website.

• Assist with developing call center scripts for the FFCPD call center.

• Conduct special studies and research about issues and programs of interest to the Division and prepare reports and recommendations as assigned.

• Work on initiatives of the Superintendent and Executive Deputy Superintendent.
