Minimum Qualifications Strong preference will be given to applicants with 10 years of experience in real estate law, both litigation and real estate transactions, with demonstrated knowledge of real estate securities and affordable housing, strong supervisory experience, excellent writing skills and demonstrated commitment to public service.
Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the Office be citizens of the United States.
Duties Description The Office of the New York State Attorney General (OAG) is seeking an experienced real estate attorney to lead its premier Real Estate Finance Bureau located in New York City. The Real Estate Finance Bureau regulates the offer and sale of real estate securities including cooperative interests in realty (cooperatives, condominiums, timeshares, homeowners associations, and senior communities) and syndications under New York’s blue sky law, known as the Martin Act. The Bureau uses its statutory and regulatory authority to mandate adequate disclosure to investors of real estate securities, as well as protect purchasers and tenants affected by co-op and condominium development. The Bureau also uses the Martin Act and the New York Executive Law to investigate complaints such as misuse of purchaser down payments, failure to complete construction, misallocation of tax benefits such as 421-a, and the violation of tenants’ rights.
The Bureau Chief will supervise section chiefs, attorneys and support staff in the review and enforcement sections of the Office. The Bureau Chief will also advise and oversee the Record Room and Freedom of Information Unit, and coordinate with outside government agencies such as the New York City Department of Housing Preservation and Development.
