Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must have been admitted to the New York State bar and have at least three (3) years of post-graduate legal experience including significant trial work or administrative hearing experience, demonstrating progressively responsible experience in such areas.

PREFERRED QUALIFICATIONS: Experience prosecuting cases of sexual abuse strongly preferred.

Duties Description The New York State Education Department’s (NYSED) Office of the Professions anticipates filling an Assistant Counsel position in its Office of Professional Discipline (OPD) in the Buffalo, Rochester OR Syracuse office. Under the direction of the OPD management and a supervising attorney, the incumbent will participate in the development and review of investigations into allegations of professional misconduct. Other duties will include, but are not limited to, the following:

• Provide legal advice to OPD investigators and members of the various State boards for the professions;
• Engage in settlement negotiations in professional misconduct cases;
• Prepare for hearings and try before panels of the various State boards: professional misconduct cases, moral character cases involving individuals seeking licensure, and restoration of license cases involving individuals whose licenses have been previously revoked or surrendered;
• Represent OPD before the Regents Review Committee, which reviews decisions of hearing panels in professional misconduct cases;
• Research and prepare well-written briefs, memoranda of law, specifications of professional misconduct, other legal pleadings, internal memoranda, and correspondence;
• Ensure the effective and timely management of all caseloads;
• Interact courteously and effectively with members of the Board of Regents and the various State professional boards, other SED staff, opposing counsel, witnesses, and members of the public.
• Under supervisory direction, work with upstate investigations and prosecute serious and/or complex litigation misconduct cases across the upstate regional offices;
• Under supervisory direction, assist in the development and conduct of internal training jointly with investigations and prosecutions, as needed, in areas of expertise, including such things as sexual abuse cases, complex issue cases and other types of misconduct cases as the need arises; and
• Assist, on occasion and as directed by supervisory staff, with networking with law enforcement across upstate offices on cases that we have in common or cases referred to law enforcement or referred to us from law enforcement.

Additional Comments CONDITIONS OF EMPLOYMENT: This will be an exempt appointment and the incumbent will serve at the discretion of the Commissioner of Education. Frequent same-day travel and occasional overnight travel throughout the State will be required. Filling of this position is contingent on Division of Budget approval.
