Minimum Qualifications MINIMUM QUALIFICATIONS:

Permanent appointment: One year of permanent competitive service as an Associate Attorney OR be reachable on the Associate Attorney eligible list OR have one year of permanent competitive or 55 b/c service in a title eligible for transfer under Section 52.6 of the Civil Service Law AND you must be a graduate of an accredited law school with a JD degree and have been granted admission to the New York State Bar Association.

Duties Description The New York State Education Department’s (NYSED) Office of Counsel (OC) is seeking applicants for the position of Associate Attorney. The OC provides the Regents, the Commissioner and the Department with legal counsel and services that enable them to establish education policy and comply with the law. The incumbent of this position will assist the Department’s Counsel and Deputy Commissioner for Legal Affairs in providing confidential legal services to the State Board of Regents, the Commissioner of Education, and high-level Department managers on Education laws and regulations. Duties of this position will include, but are not limited to, the following:

• Provide legal advice and counsel and assist in the drafting and review of Department regulations and guidance;
• Perform necessary research and draft proposed decisions in appeals of actions or decisions of local school district officials brought to the Commissioner for resolution under Education Law §306 and §310 and other related appeal processes, including but not limited to Freedom of Information Law (FOIL) appeals, and assist in the review of such proposed decisions;
• Provide legal advice and counsel on issues related to the chartering and consent process for not-for-profit education corporations;
• Provide effective and necessary assistance to the Attorney General (AG) in litigation handled by the AG and provide effective representation in litigation and administrative proceedings handled by the Department’s Office of Counsel;
• Handle Human Rights complaints and other employment-related matters involving confidential personnel information;
• Respond to and/or coordinate responses to subpoenas, as assigned;
• Review and prepare recommendations on complex legislative proposals developed both within and outside of the Department;
• Assist in preparing and reviewing bill comments and ten-day bill memoranda;
• Perform a variety of legal services, with minimal supervision, including legal research, preparing legal briefs, negotiating and preparing legal documents and similar functions;
• Handle special assignments as requested by the Counsel or management team;
• Supervise senior attorneys, make and review legal assignments, and provide or direct appropriate training;
• Direct subordinate staff in the preparation of technically complex, precedent setting or other difficult casework;
• Assist in the determination of assignment priorities in accordance with organizational needs or timetables;
• Participate on assigned Office of Counsel functional work teams; and
• Supervise and assign tasks to administrative staff.

Additional Comments CONDITIONS OF EMPLOYMENT: This will be a permanent appointment. Promotions and transfers may change appointees’ negotiating unit.
