Minimum Qualifications NYS employee with one year of permanent or contingent-permanent competitive service as a Senior Attorney (G-25); OR a NYS employee with one year or more of permanent or contingent-permanent competitive service in a title at Grade 23 or above with current NYS Bar Admission and eligible for transfer to Senior Attorney under Sections 70.4 or 52.6 of the Civil Service Law. (Candidates requesting consideration for transfer must also be a graduate of an accredited law school with a LLB or JD degree.)

Preferred Qualifications
The preferred candidate should be a highly motivated individual interested in working in public service, with at least three years experience as a New York State Attorney. Preferred qualifications include prior litigation experience, ability to demonstrate sound judgment, excellent written and oral communication skills, and a desire to learn new subject areas.

Duties Description The Department of Motor Vehicles’ Office of Special Counsel (OSC) is seeking to fill a Senior Attorney, G-25 position in Albany with a candidate possessing litigation experience. The primary duties would include representing the Department at complex or high profile administrative hearings before the Department's Administrative Law Judges (ALJs), and occasionally the ALJs of other Departments. Representation may include the drafting of charges and orders of suspension or revocation (including suspension pending hearing (SPH) orders), presenting cases at administrative hearings, settlement negotiations and drafting of agreements, as well as providing advice or assistance to staff on legal issues.

The types of cases the OSC handles includes the more complicated cases against Art. 19-A bus carriers (e.g., cases with many individual charges, “drunk bus driver” cases, suspension pending hearing cases, and cases where there is a strong public safety component), cases against driving schools and Point and Insurance Reduction Program (PIRP) providers engaged in fraudulent activity, and defending the Department at loss of consciousness hearings under Part 9 of the Commissioner's Regulations. The OSC also represents the Department in disciplinary cases before arbitrators and before ALJs in the Division of Human Rights. Finally, OSC may be called upon to provide advice on the drafting of charges, and case preparation and management to the Office of Vehicle Safety in cases against repair shops (fraud and non-quality repairs), new and used car dealers, and inspection stations.

The ideal candidate will have prior litigation experience, preferably in an administrative setting, as well as a desire to learn and excellent communication skills.
