Interested candidates must be eligible to transfer under section 52.6 of the Civil Service Law. Candidates must have at least one year of permanent competitive or 55 b/c service in a qualifying title allocated to a grade 23 or higher. Qualified candidates must hold a Juris Doctorate degree and be admitted to the Bar to practice law in New York State.

Duties Description Under the direction of the Associate Attorney within the Bureau of Financial Administration, Special Funds, the incumbent will be responsible for overseeing and implementing the ongoing administration and closure of claims established pursuant to Workers’ Compensation Law. Duties include, but are not limited to the following:
• Assisting with all legal tasks associated with claims administration and oversight, and reimbursement processing duties of the Special Funds Group, and service the various Special Funds Group units, i.e., WAMO/ Retail Agreements, Claims and Third Party Contracts/Settlements, Special Funds Processing and Special Funds Financial Management;
• reviewing settlement recommendations for Retail and Wholesale Waiver Agreements;
• reviewing and approving Section 32 settlement agreements, legal review and determination on claim specific inquiries and issues [i.e., 110-a, 114-a, related cases, Medicare eligibility, Medicare Set Aside approvals, apportionment, voluntary withdrawal];
• assisting with the implementation and tracking of Special Funds Conservation Committee 15(8) and 25-a transition of legal tasks;
• drafting legal documents and forms related to the oversight of the carrier and employers administration of Special Funds claims as well as the reimbursement for and, where appropriate, resolution, via individual or broader scale agreements, of such claims;
• representing Special Funds Group programs, as necessary, at hearings, including Section 32 hearings, and other legal forums, and taking any related actions required [i.e., withdrawal, appeal, rebuttal];
• responding to outside parties and agencies with regard to claims and other matters as assigned;
• assisting in any bonding or contracting process related to Special Funds;
• conducting legal research and writing on Special Funds related issues as required;
• responding to requests for information or action from other WCB units regarding Special Funds Group matters;
• overseeing work assignments and balancing the workload against staff availability among any staff supervised; and,
• performing any other tasks and special projects, reports, etc. related to the handling of Special Funds cases or other Financial Administration office matters.
