Minimum Qualifications MINIMUM QUALIFICATIONS:
Reassignment: One year of permanent competitive or 55b/c service as a Legal Assistant 1.
§70.1 Transfer: Candidates must have one year of permanent competitive or 55 b/c service in a title SG-12 or above deemed eligible for transfer under Section 70.1 of the Civil Service Law. To transfer to the Legal Assistant Trainee, candidates must have an Associate’s degree or certificate in legal studies, paralegal studies, or legal assistant studies from an accredited institution or one approved by the American Bar Association or have graduated from an accredited law school.
Eligible List Appointment: Candidates who are reachable on the Legal Assistant 1 or Legal Assistant Trainee 1 eligible list may be considered for appointment.
*Leads to a maximum salary of $54,806 based on annual performance advances.

Duties Description The New York State Education Department’s (NYSED) Office of Counsel (OC) is seeking applicants for the position of Legal Assistant 1. The OC provides the Regents, the Commissioner and the Department with legal counsel and services that enable them to establish education policy and comply with the law. The Legal Assistant 1 will assist attorneys with the chartering process for education corporations, review and respond to petitions for charter actions, create corporate charter documents for education corporations, prepare summary items for Board of Regents approval, and maintain the charter database and physical files. Other duties of this position will include, but are not be limited to, the following:
• Assist attorneys with the Commissioner’s consent process for all business, Not for Profit and other corporations;
• Review incoming mail for the determination of the issuance of Commissioner’s consents;
• Draft letters and respond to emails;
• Answer telephone inquiries;
• Assist with filing of regulatory documents with Department of State for publication in the State Register and with the preparation of certifications for such filings;
• Assist in drafting decisions under Part 87 of the Commissioner’s regulations;
• Review case files, research and analyze, and draft letter decisions;
• Prepare draft decisions for attorney review;
• Assist attorneys by providing a preliminary review and analysis of records and perform additional legal research, as required;
• Assist with preparation of appeals under Education Law §310 by assisting attorneys in handling complex §310 appeals by providing a preliminary review and analysis of the record and drafting and legal research, as required;
• Assist with Freedom of Information Law (FOIL) requests and appeals to the Commissioner of Education;
• Assist OC attorneys with correspondence and document production in connection with litigation matters, subpoenas and administrative proceedings; and
• Assist the Office Appeals Coordinator and other staff as needed and participating effectively on assigned OC project teams.
Additional Comments CONDITIONS OF EMPLOYMENT: This will be a contingent permanent appointment. Filling of this position is contingent upon Division of Budget approval. Salary above applies to candidates appointed to Legal Assistant 1, SG-14. The hiring rate for candidates appointed to Legal Assistant Trainee 1 starts at $37,124 and, for current NYS employees, is based on the candidate’s salary at the time of hire. Candidates hired into the traineeship will be advanced to Legal Assistant 1 upon successful completion of a (two) year traineeship.
