Minimum Qualifications Eligible for a lateral transfer or eligible for a 52.6 transfer by having one year of permanent competitive service in an appropriate title;

OR

Candidates must be reachable on the current eligible list for Hearing Officer in Brooklyn. Candidates who are currently on the eligible list for the Hearing Officer in Brooklyn need not submit an application for this posting unless they are applying directly as a result of the transfer qualifications listed above.

Note: Candidates must be law school graduates who are admitted to the New York State Bar and whose membership is in good standing. Please be sure to include in your resume or cover letter the specific Civil Service title which qualifies you for transfer under Section 52.6 of the Civil Service Law.

Duties Description Under the direction of a Supervising Hearing Officer, the Hearing Officer is responsible for the conduct of fair hearings designed to settle disputes between clients or applicants and local social services districts/agencies relative to the discontinuance, denial, adequacy or reduction of either Family Assistance, Safety Net Assistance, Medical Assistance, Supplemental Nutrition Assistance Program, and/or Services. In New York City, hearings are conducted at a central hearing site. However, traveling to a homebound appellant’s home to conduct the hearing may sometimes be required.
Tasks involve:
• Reviewing the appellant’s fair hearing case file to determine probable issues and applicable regulation and law and preparing required case statistical records;
• Conducting hearings by eliciting testimony from both parties relative to the issues of the hearing, ruling on requests for hearing adjournment received from either the appellant or the local agency, ruling on the admissibility of evidence and exhibits, and maintaining a clear record of the proceeding for use in determining the facts;
• Preparing draft recommendations for the Commissioner’s approval by evaluating the evidence developed during the hearing, determining the facts of the case, and applying appropriate Social Services rules and regulations and applicable Law to the facts and evidence;
• Submitting decisions in a timely manner;
• Maintaining currency of professional skills and utilizing legal resources appropriately as they pertain to the fair hearing process;
• Following office/administrative procedure in the maintenance of an orderly case file and completing all relevant forms and procedural expectations, such as accurate recording of the federal data sheet, calendar dispositions and all information and submissions necessary to a proper hearing record;
• Maintaining professional and courteous conduct and demeanor and demonstrating an understanding of the significance of the administrative review process and the role of the Hearing Officer in that process.

Additional Comments A full-time, contingent-permanent appointment will be made. Travel to conduct hearings may be required for this position. If certified by Civil Service, mandatory reemployment list candidates must be considered first for appointment to this title.
This position includes a location pay of $3026.00.
