Minimum Qualifications MINIMUM QUALIFICATIONS:
Reassignment: One year of permanent competitive or 55b/c service as a Senior Attorney.
§70.1 Transfer: One year of permanent competitive or 55b/c service as a Senior Attorney Realty.
§52.6 Transfer: One year of permanent competitive or 55b/c service in a title SG-23 or above deemed eligible for transfer under Section 52.6 of the Civil Service Law. Candidates must be a graduate of an accredited law school with an LLB or JD degree and/or be eligible to take the New York State Bar examination.
Eligible List Appointment: Candidates who are reachable on the Legal Specialties eligible list may be considered for appointment.

Duties Description The New York State Education Department’s (NYSED) Office of Professions (OP) is seeking to fill (3) Senior Attorney positions in the Office of Professional Discipline (OPD). Under the direction of a Supervising Attorney, the duties of these positions will include, but are not limited to, the following:
• Participate in the development and review of investigations into allegations of professional misconduct;
• Provide legal advice to OPD investigators and members of the various state boards for the professions;
• Engage in settlement negotiations in professional misconduct cases;
• Prepare for hearings and try professional misconduct cases, moral character cases involving individuals seeking licensure, and restoration of license cases involving individuals whose licenses have been previously revoked or surrendered before panels of the various state boards;
• Represent OPD before the Regents Review Committee, which reviews decisions of hearing panels in professional misconduct cases;
• Research and prepare briefs, memoranda of law, specifications of professional misconduct, other legal pleadings, internal memoranda, and correspondence;
• Ensure effective and timely management of caseload; and
• Interact courteously and effectively with members of the Board of Regents and the various state professional boards, other NYSED staff, opposing counsel, witnesses, and members of the public.
Additional Comments CONDITIONS OF EMPLOYMENT: These will be permanent or contingent permanent appointments. Filling of these positions are contingent upon Division of the Budget approval. Candidates will be required to provide proof of degree and transcripts. Promotions and transfers may change appointees’ negotiating unit. Applicants should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. These positions may require occasional travel, including overnight travel to other locations throughout NYS.
*Leads to a maximum salary of $94,834 based on annual performance advances.
** Plus $3,026 annual downstate location adjustment.
Candidates on the Legal Specialties eligible list with less than 24 months of experience must serve a traineeship with advances at 6-month intervals until eligible for appointment at the Senior Attorney level. The salary listed above applies to candidates appointed to Sr. Attorney, SG-25. The hiring rate for candidates appointed to Attorney Trainee 1 starts at $48,738, and for current NYS employees, is based on the candidate’s salary at the time of hire. Candidates hired into a traineeship will be advanced to Sr. Attorney upon successful completion of a two-year traineeship.
