Minimum Qualifications Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the Office be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.
Duties Description The New York State Office of the Attorney General is seeking an experienced lawyer to serve as Deputy Bureau Chief in its Labor Bureau in New York City. The Bureau brings civil and criminal prosecutions for violations of minimum wage, overtime, prevailing wage, and other labor laws. The Bureau has been nationally recognized for enforcing labor standards in low-wage industries such as the fast food, car wash, and construction industries. The Bureau has undertaken initiatives to address emerging issues in the labor field, such as payment of wages by payroll card, on-call scheduling and unenforceable non-compete agreements. The Bureau also represents (a) the New York State Department of Labor in Article 78 and other proceedings, typically in cases where employers challenge the Department’s enforcement actions and (b) the Department of Labor and the New York State Workers’ Compensation Board primarily in appeals to the Appellate Division of determinations by the State concerning unemployment insurance and workers’ compensation benefits. The Bureau has approximately twenty (20) attorneys.
The Deputy Bureau Chief responsibilities include overseeing and advancing the Bureau’s civil enforcement efforts, overseeing the Bureau’s representational work for the Department of Labor and Workers’ Compensation Board, reviewing briefs, managing lawyers and support staff, working closely with the Bureau Chief to develop and execute enforcement vision and strategy using litigation, policy, and educational tools, and supervising and engaging in strategic outreach.
We are seeking candidates with at least eight (8) years of experience. Applicants should have significant investigatory and litigation experience and extensive knowledge of federal, state, and local labor laws. Applicants with prior supervisory and leadership experience are strongly preferred.
