Minimum Qualifications Candidates must have one year of permanent competitive service as a Senior Attorney or one year of permanent, competitive service in a title eligible for transfer under 52.6 of the Civil Service Law, AND admission to the New York State Bar.

Duties Description The NYS Office of Information Technology Services (ITS) was created in the fall of 2012 to provide consolidated and consistent information technology (IT) to NYS agencies and to effect consistent and cutting edge technology policy across NYS agencies. ITS is seeking a Senior Attorney to join ITS’s Division of Legal Affairs (DLA). The DLA is comprised of the Offices of House Counsel, Litigation, and Investigations.

The Senior Attorney, under the general direction of a DLA department head or designee, will provide ITS, including its program areas, project teams, Clusters, and executive management, with legal and policy-related advice, support, and guidance on IT-related initiatives, projects, and operations. This includes providing policy and legal advice, support, and guidance related to the direction, implementation, and maintenance of major technology initiatives; provision of world class IT services to customer agencies; and administration of an agency with over 4,000 employees spanning approximately 150 sites across the State. As part of the DLA, the Senior Attorney will take part in the planning and staging of the State’s consolidated use and deployment of sophisticated technology solutions such as converged networking and unified communications (including Voice-Over Internet Protocol) and cloud-related services. The Senior Attorney will also take part in ensuring that ITS is compliant with the laws, rules, and regulations that impact the agency’s administration and operations.

The Senior Attorney provides the following legal services to ITS program areas, project teams, Clusters and executive management:

- Researches, advises, provides assistance and interpretations on legal and policy issues relating to pre-existing, new and cutting edge deployment of technology across State agencies;

- Drafts and applies ITS’ regulations, policies and guidelines on such matters as the Electronic Signatures and Records Act (ESRA), online personal privacy, IT security, online identity and access management requirements, website accessibility, FOIL, acceptable use of IT resources and social media use;

- Drafts and interprets inter-agency agreements and other legal documents to effectuate the coordination of the State’s provision of IT services;

- Drafts and reviews legislation relating to the provision of IT services and other programs related to ITS; and

- Drafts and negotiates IT hardware, software, maintenance services and related contracts with commercial vendors.

Additional Comments This is an Office of Information Technology Services (ITS) position in the Chief General Counsel’s Office and will be located in the Swan Street Building, Core 4, Empire State Plaza, Albany. Some positions may require fingerprinting.
