Duties Description Manage the agency’s Employment Law Bureau within the Division of Legal Affairs.

The Bureau is devoted primarily to providing legal recommendations with respect to internal complaints of workplace discrimination brought by employees, representing the interests of the agency in connection with external complaints of workplace discrimination before the New York State Division of Human Rights (DHR), liaising with the New York State Attorney General’s Office with respect to the litigation of protected class matters, and providing legal guidance to agency programs and executive staff with respect to myriad employment law issues including, but not limited to, reasonable accommodations, criminal history, discipline pursuant to collective bargaining agreements, and the hiring and termination of employees.

Responsible for, among other things, implementing agency, division and bureau priorities within established timeframes;

Utilizing effective leadership skills to balance staff development and productivity while keeping Counsel’s Office apprised of emergent issues;

Developing subordinate staff including appropriate corrective action;

Interacting positively and productively with program staff and supervisors and other agency representatives and the public;

Attend and present at agency meetings and hearings in a thoughtful, concise and persuasive manner;

Collaborate with agency program areas to effectively resolve problems in accord with agency goals

Research legal issues and effectively presenting solutions to legal issues in written and oral format

Identify potential legal issues and their impact on the agency and presenting viable solutions.

Supervise bureau attorneys and staff and overseeing the bureau’s work in addition to the candidate’s own litigation and administrative responsibilities

Reviewing Equal Opportunity and Diversity Development Office reports and supporting documentation of investigations of internal and external complaints of workplace discrimination

Prepare written recommendations for discipline varying in complexity and preparing responses to DHR complaints

Collaborate with bureau attorneys and the Attorney General’s Office in the defense of the agency related to protected class litigation

Representing the agency with respect to Civil Service Article 73 and 75 proceedings; representing the Legal Division on various internal committees
Perform attendant litigation tasks such as the preparation of pleadings, the compilation of responses to discovery demands, preparation and handling of hearings and trials, negotiation of settlements and the preparation of settlement documents.
