Minimum Qualifications Interested candidates must be reachable on the open competitive Legal Specialties list or be eligible to transfer under Section 52.6 of the Civil Service Law and meet the special qualifications as listed below:
To be eligible for transfer under Section 52.6:
Candidates must have one year of permanent competitive service in a qualifying title allocated to
grade 23 or higher and must have six months as an Attorney 2 OR admission to the New York
State Bar AND 24 months of subsequent satisfactory legal experience.
Duties Description • Representing the Retirement System at administrative hearings. Assemble, review and prepare case file in preparation for administrative hearings; prepare expert and lay witnesses; make or respond to motions, objections; travel to and attend hearings; conduct direct and cross examination of witnesses at administrative hearings; draft hearing related documents, correspondence; prepare post-hearing memorandum of law.
? Evaluate cases, interview clients, and analyze and prepare cases for trial/hearings.
? Research legal issues utilizing relevant legal authorities and research tools.
? Draft cogent legal arguments, briefs and motions for administrative evidence rulings.
? Write in a clear and convincing manner: memoranda of law, research and opinion memoranda, correspondence.
? Present oral arguments, and conduct direct examinations and cross-examination of lay and expert witnesses in administrative hearings.
? Respond to rules of evidence arguments made by opposing counsel.
? Review and prepare legal documents, supporting documentation, legislation, regulations.
? Travel, primarily in New York State using both public and private transportation modalities, occasionally overnight, to attend meetings with other retirement systems and/or hearings.
• Non-hearing related duties. Provide legal advice to staff on agency determinations. Review documents submitted to the Retirement System, including but not limited to powers of attorney, trusts and guardian papers; provide legal opinions and policies on Retirement System related topics; work with other OSC divisions and outside entities on retirement related investigations.
? Provide legal advice to agency personnel and others on retirement and social security law and its implications for disability retirement benefits.
? Interview and question Retirement System staff in preparation for litigation and/or administrative hearings.
? Draft correspondence in response to inquiries concerning retirement and disability applications and other legal issues.
Additional Comments Desired Competencies:
1) Attorney, admitted to practice in New York.
2) Two years of legal experience.
3) Excellent written and oral communication skills.
4) Excellent legal research skills and ability to analyze legal issues.
5) Experience conducting administrative hearings.
6) Ability to travel within NYS.
