Minimum Qualifications Interested candidates must be reachable on the open competitive Legal Specialties list or be eligible to transfer under Section 52.6 of the Civil Service Law and meet the special qualifications as listed below:
To be eligible for transfer under Section 52.6:

Candidates must have one year of permanent competitive service in a qualifying title allocated to
grade 23 or higher and must have six months as an Attorney 2 OR admission to the New York
State Bar AND 24 months of subsequent satisfactory legal experience.

Duties Description Preparation of Memoranda Responding to Ethics Inquiries
• Research and analyze ethical inquiries with reference to precedent, law, regulations and policies;
• Provide verbal advice and prepare timely written draft and final responses for Special Counsel’s review, including guidance to be issued to OSC officers and employees on such matters as permissible gifts, outside activities, nepotism, political activities, contracting with State agencies, codes of conduct, post-employment restrictions and procurement integrity;
• Exercise initiative when novel questions arise to prepare a written response, in concert with Special Counsel or other Ethics/Privacy Unit staff.
• Recognize the implications of job-specific issues, considering the responsibilities of various OSC staff, such as investment officers, investigators, and auditors. Special projects as assigned.







Privacy-Related Tasks
• Assist in the preparation of Memoranda of Understanding with State agencies or Non-Disclosure Agreements with other parties, regarding the use of electronic data shared by OSC with those external users.
• Assist in the preparation of appropriate documentation regarding the requests for, and use of, electronic data from external sources, such as other government agencies, necessary for the fulfillment of OSC’s constitutional and statutory duties and responsibilities.
• Assist in the preparation of policies and memoranda to fulfill the Agency’s responsibilities regarding privacy of data collected for various Agency purposes or shared externally.
• Prepare materials for consideration of the Privacy Committee; attend and participate at Committee meetings.
• Assist in implementing the Internal Audit report’s recommendations regarding the implementation of the Agency’s privacy responsibilities, with particular emphasis on electronic data collection and development of consistent policies and procedures governing use, protection and retention and destruction, both internally and for external users.
• Perform necessary research to identify and resolve privacy-related legal issues.

Training and Communication
• Deliver ethics training programs for new employees and for financial disclosure filers.
• Assist in the development and delivery of OSC Division-specific ethics training programs on request.
• Assist in the preparation of updated privacy training materials and in the delivery of privacy training programs.
• Maintain the currency of materials on the OSC Intranet site relating to ethics and privacy topics.
• Recommend new opportunities for informing staff regarding applicable laws, regulations and policies, preparing appropriate bulletins, remarks, handouts, PowerPoints, or other training-appropriate presentation materials.

• Some experience with New York State’s ethics laws, regulations, opinions and policies
