Minimum Qualifications The ideal candidate will have a broad knowledge of the law and policy issues related to the electric and natural gas industries, as well as an understanding of environmental law and emerging energy industries such as the alternative fuels and distributed generation industries. Knowledge or experience in natural resources law and climate change is also desired, as is experience in consumer protection matters.

Applicants must be a member of the New York Bar, licensed to practice law in another state having reciprocity with New York State, or be willing and able to take the New York Bar exam at the first available opportunity. Litigation experience in public utility regulation is desirable. Excellent writing, analytical and oral advocacy skills are required.

Duties Description The Department of State (DOS) is seeking an attorney familiar with energy law to provide legal support and counsel to the Utility Intervention Unit (UIU) within the Division of Consumer Protection. The UIU is charged with representing the interests of consumers before federal, state, and local agencies engaged in the regulation of energy, water, and telecommunication services. UIU staff participate in matters before the Public Service Commission (PSC), the New York Independent System Operator (NYISO), and the Federal Energy Regulatory Commission (FERC), as well as several utility and energy-related interagency working groups, task forces, and committees including the Low-Income Forum on Energy Steering Committee, Energy Efficiency Collaborative, Home Energy Assistance Program Interagency Task Force, and the Natural Gas Reliability Advisory Group.
The Lead Counsel will advocate on behalf of consumers to ensure reliable utility service at the lowest reasonable cost, with an emphasis on the interests of residential and small business customers. The attorney will report to the General Counsel. The position is based in Albany, but could be located in the NYC Office for the right candidate.
The Lead Counsel to the UIU shall:
• Advocate for advocating UIU’s positions in rate and energy policy proceedings, including the Governor’s Reforming the Energy Vision (REV), Clean Energy Standard, and other related climate change initiatives.
• Conduct discovery, undertake cross-examination of other parties’ expert witnesses as well as examination of UIU witnesses, and assist in preparing testimony, in administrative proceedings and litigation.
• Draft pleadings, briefs, motions, legal memoranda, and comments that are submitted to PSC and FERC administrative law judges;
• Conduct settlement negotiations to resolve issues relating to proceedings and meetings before the PSC, FERC, and the NYISO;
• Represent and advocate for UIU’s position in meetings and collaborative proceedings, including those involving energy efficiency, offshore wind development, and other renewable technologies;
• Assist UIU with resolving utility-related consumer complaints; and
• Coordinate with the Office of the Attorney General as necessary to provide any additional legal support regarding UIU-related litigation or pre-litigation matters, such as drafting amicus briefs.

Additional Comments Salary will be commensurate with experience. This position is in the Exempt Jurisdictional Class and is designated Management/Confidential.
