Duties Description The Office of Counsel provides legal guidance and services to the Office for People With Developmental Disabilities (OPWDD) network on the myriad of issues arising from the delivery of supports and services to individuals with intellectual and developmental disabilities (IDD). Attorneys are called upon to draft and review legislation, regulations, contracts, and real property transactions, provide advice on federal and State health care delivery and funding, advise on employment matters, participate in administrative hearings and oversee litigation.
This position will act as the Deputy Counsel for the Service Delivery and Program Compliance Bureau within OPWDD Counsel’s Office. Reporting to the General Counsel, the Deputy Counsel supervises attorneys and other professionals assigned to the Bureau and oversees the provision of legal advice and supports in the areas of:
• OPWDD eligibility and service authorization;
• Medicaid fair hearings;
• Objection to care and due process;
• Transition from school to adult services;
• Consent to services and substituted decision-making;
• Individual rights and protections;
• Health care and end-of-life issues;
• Guardianship;
• Incident management;
• State Operated programming and residential services;
• Care Coordination Organization services;
• Provider approval and certification; and
• Program compliance and oversight.

Preferred Qualifications:
The Deputy Counsel for the Bureau of Service Delivery and Program Compliance is an attorney admitted to practice in New York State with at least 7 years post bar experience practicing law. Strong analytic and writing skills, and the ability to read, comprehend and analyze complex, detailed and technical statutes and regulations, along with the ability to draft all kinds of legal documents. Excellent written and oral communication skills and ability to work with top and middle management. Ability to supervise and direct other attorneys. Knowledge of administrative law, health or disabilities law is preferred but not required.
