Minimum Qualifications MINIMUM QUALIFICATIONS:
Reassignment: Candidates must have one year of permanent competitive or 55b/c service as a Senior Attorney.
Section 70.1 Transfer to Senior Attorney: Candidates must have one year of permanent competitive or 55 b/c service as a Senior Attorney (Realty).
Section 52.6 Transfer: Candidates must have one year of permanent competitive or 55b/c service in a title allocated to SG-23 or above deemed eligible to transfer under Section 52.6 of the Civil Service Law AND possess a Juris Doctorate degree AND be admitted to the Bar to practice law in New York State, or in a state with Bar reciprocity.
Eligible List Appointment: Candidates must be reachable on the Legal Specialties Civil Service eligible list. If you are on the Civil Service eligible list for this title, you may receive a canvass letter. You must complete and return it as instructed on the letter.
Duties Description The New York State Education Department’s Office of Education Policy is seeking candidates for a Senior Attorney position in the Office of the Deputy Commissioner for Higher Education. This Office manages teacher certification, college and university evaluation, and student and educator professional development. Duties of this position include, but are not limited to, the following:
• Draft proposed changes to regulations, gather, analyze, and summarize public comments, and track the timeline for public comments and adoption of final regulations, primarily in the areas of educator preparation, certification, and licensure, and educator preparation program registration and review;
• Provide legal advice and counsel to SED managers and staff regarding compliance with laws and regulations applicable to all major program areas within the Office of Higher Education, especially educator preparation, certification, and licensure, and educator preparation program registration and review;
• Draft documents such as guidance to the field, policy memos, memoranda of understanding, and proposed legislation relating to all major program areas within the Office of Higher Education;
• Provide advice and counsel to SED managers and staff on legal issues related to the development of policies and programs in all major areas within the Office of Higher Education; and
• Serve as a liaison to the Office of Counsel on legal issues such as administrative and court proceedings challenging SED actions, policies, or administrative determinations in all major areas within the Office of Higher Education.
Additional Comments CONDITIONS OF EMPLOYMENT: This will be a contingent permanent appointment. Promotions and transfers may change appointees’ negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Verification of degree and admission to the New York State Bar will be required at the time of interview for all candidates. Continued employment as a Senior Attorney is dependent upon maintaining admission to the New York State Bar. Failure to maintain admission to the New York State Bar will result in removal from employment.
* Leads to a maximum salary of $102,661 based on annual performance advances.
