Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must have one year of permanent competitive or 55b/c service as a Senior Attorney OR one year of permanent competitive or 55b/c service in a title eligible for transfer under Section 52.6 or 70.1 of the Civil Service Law OR reachable on the Legal Specialties eligible list. In addition, qualified candidates must hold a Juris Doctorate degree and be admitted to the Bar to practice law in New York State or in a state with Bar reciprocity.

Candidates on the Legal Specialties eligible list with less than 24 months of experience must serve a traineeship with advances at 6-month intervals until eligible for appointment at the Senior Attorney level.

Duties Description The New York State Education Department’s Office of State Review is seeking to applicants to fill the position of Senior Attorney. The Office of State review is responsible for reviewing the decisions of impartial hearing officers concerning the identification, evaluation, program or placement of children who have, or are suspected of having, an educational disability. The Senior Attorney will work under the direction of the State Review Officer. Duties of this position will include, but not be limited to:
• Maintaining an expertise in special education law, legal research and legal writing;
• Analyzing the facts and laws in each appeal in light of the extensive procedural and substantive provisions of federal and State law relating to children with disabilities;
• Preparing written draft decisions which accurately identify the factual and legal issues to be determined, making recommendations in a clear, concise and logical manner;
• Managing assignments to ensure timely completion of quality decisions; and
• Working collaboratively and effectively with other staff.

Additional Comments CONDITIONS OF EMPLOYMENT: This will be a permanent contingent appointment.

*Leads to a maximum salary of $92,974 based on annual performance advances.
