Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must have a bachelor’s degree or JD AND five years of progressively responsible experience in developing, implementing and managing information security programs in a large organization, with at least two of those years in a supervisory capacity, OR seven years of experience dealing with complex legal and/or regulatory compliance related to information security and privacy laws, regulations and best practices.

Duties Description The New York State Education Department’s Office of Higher Education is seeking candidates to fill a Chief Privacy Officer, M-2 position. The incumbent of this position will oversee all ongoing activities related to the development, implementation and maintenance of, and adherence to the Department’s policies and procedures covering the privacy of, and access to, student, teacher and principal data. Duties of the position include, but are not limited to:
• Serve as a senior advisor to the Commissioner on Departmental policies and programs related to privacy and confidentiality.
• Develop and implement security policies and procedures to ensure the privacy and security of student, teacher and principal data.
• Lead the New York State Education Department’s (NYSED) investigation of and response to security breaches and privacy-related emergencies and recommend required actions(s) to NYSED executive management.
• Provide technical assistance to educational agencies within the State on minimum standards and best practices associated with privacy and the security of student, teacher and principal data.
• Develop and administer a procedure within the Department whereby parents, students, teachers, superintendents, school board members, principals and other persons or entities the Chief Privacy Officer determines is appropriate, may request information pertaining to student, teacher or principal data in a timely and efficient manner.
• Establish and administer a protocol for the submission of complaints of possible breaches of student, teacher or principal data by third party contractors.
• Make policy recommendations, as needed, regarding privacy and the security of student data on behalf of the Department to the Governor, the Speaker of the Assembly, the Temporary President of the Senate and the Chairs of the Senate and Assembly Committees.
• Develop and issue an annual report on data privacy and security activities and progress, including the number and disposition of reported breaches, if any, and a summary of any complaint submitted.

Additional Comments CONDITIONS OF EMPLOYMENT: This will be a temporary non-competitive appointment. Filling of this position is contingent on Division of Budget approval.

*Leads to a maximum salary of $95,679 based on annual performance advances.
