Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must have a J.D. degree, be admitted to the New York State Bar, have at least three years of legal experience and have significant litigation experience or legal writing experience such as appellate brief writing or judicial clerkship experience.

PREFERRED QUALIFICATIONS: Special consideration will be given to candidate who have experience in Special Education law, managerial and/or supervisory experience and/or training, and possess superior writing and research skills.

Duties Description The New York State Education Department’s (NYSED) Office of State Review (OSR) is seeking applicants for the position of Assistant Counsel, NS. The Office of State Review (OSR) assists the New York State Review Officer (SRO) in reviewing appealed decisions of impartial hearing officers concerning the identification, evaluation, program, or placement of children who have, or are suspected of having, an educational disability. This is a critical leadership position in OSR, and the Assistant Counsel must work closely with OSR's Management Team and be able to motivate staff through leading by example, hard work, and commitment. The duties of this position will include, but not be limited to, the following:

• Assisting in the effective management of OSR;
• Assisting with the rapid screening and assignment of appeals and tracking and reporting of cycle time, ensuring quality decisions consistent with federal and State laws and litigation matters;
• Reviewing and editing draft decisions for accuracy, thoroughness, consistency, and quality within designated timelines;
• Providing support for the State Review Officer in fulfilling the mission of the office by being an effective member of the management team and by ensuring implementation of office policies and procedures as developed by the State Review Officer; and,
• Providing constructive comments and guidance to all staff, as well as conveying and facilitating an understanding of the office mission.

Additional Comments CONDITIONS OF EMPLOYMENT: This will be an exempt appointment. The incumbent of this position will serve at the pleasure of the Commissioner of Education. Filling of this position is contingent upon Division of Budget approval.
