Minimum Qualifications Promotion Qualifications:

One year of permanent service as a Minority Business Specialist 1, SG-18; Affirmative Action Administrator 1, SG-18; or Compliance Specialist 1, SG-18.

Non-Competitive Qualifications:

Five years of experience in the planning, development, implementation, and review of programs dealing with equal employment opportunity, human rights, affirmative action, minority business program coordination, affirmative action compliance review, labor relations directly relating to affirmative action, or in the development and administration of programs directly related to minority community access to employment or business opportunities in the public and private sector. One year of this experience must have been in a management or supervisory capacity. Graduate and undergraduate credits may be substituted for experience, on the basis of 30 credit hours for each six months of experience.

Duties Description Under the direction of the Director of Regulation and Compliance, the Minority Business Specialist 2 (MBS 2) will be responsible for all activities of the Commission and Funds related to meeting the compliance of Article 15-A of Executive Law, the rules and regulations contained within 5 NYCRR Parts 140-44, Article 9, Section 2879 of Public Authorities Law. The MBS 2 will take part in all activities related to gaming facility licensees meeting the compliance of Article 15-A of Executive Law, the rules and regulations contained within 5 NYCRR Parts 140-44, as provided in 9 NYCRR §§ 5311 - 5312.5.

Duties of the MBS 2 will include, but not be limited to, the following:

Commission and Funds

• Work with senior staff and managers to develop the Commission’s annual M/WBE goal plan.
• Provide guidance and support to Commission’s Contract Management staff on procurements and discretionary purchases to identify potential M/WBEs that may participate in solicitations.
• Provide guidance and support to the New York State Thoroughbred Breeding and Development Fund and Agricultural and New York State Horse Breeding Development Fund on procurements and discretionary purchases to identify potential M/WBEs that may participate in solicitations.
• Research M/WBE availability and establish goals for Request for Proposals, Invitation for Bids, and other purchasing by the Commission.
• Review M/WBE utilization plans submitted in response to solicitations and work with potential contractors to assure understanding of the requirements under the program and achievement of the goals set under the procurement.
• Work with Chamber staff to obtain M/WBE waivers as required.
• Ensure Commission and Fund contractors are in compliance with statutes, rules and regulations. Follow-up as necessary as provided in 5NYCRR.
• Ensure Commission and Funds are in compliance relative to quarterly reporting of M/WBE participation on Commission and Fund contracts in the B2G Now contract system maintained by Empire State Development (ESD) and that information reported is accurate. Provide direction as necessary.
• Interact with Commission’s Counsel’s Office for legal opinions and notifications to contractors as necessary.
• Ensure timely reporting of Commission and Fund use of discretionary spending on a quarterly basis.
• Participate in bi-weekly and monthly M/WBE calls held by ESD.
• Participate in training and outreach opportunities offered by ESD in relation to the M/WBE program and future initiatives.
• Participate with ESD staff in the collection of data to assist with the upcoming New York State Disparity Study.
• Develop an outreach program to communicate with the M/WBE community in an effort to increase awareness and participation in Commission contracts and purchasing.
• Keep apprised of changes in legislation that affect the M/WBE program and related policies.
• Maintain and update Commission policy and procedures related to the M/WBE program.

Gaming Facilities

• Ensure gaming facility licensees comply with all provisions of law and the rules and regulations both during construction of the facilities, following issuance of the gaming license, and after opening of the facility.
• Ensure timely submission of each licensee’s annual utilization goal plan.
• Ensure all contracts let by a licensee contain the appropriate language relative to utilization and diversity practices.
• Ensure timely submission of quarterly utilization reports and other related information from the licensees, including requests for waivers with supporting information of “good faith efforts” to attain utilization.
• Ensure timely and accurate filing of each licensee’s annual self-assessment review related to workforce diversity practices.
• Act as a liaison between external compliance consultant and the Commission to ensure expectations/tasks are being carried out. Additionally, communicate issues to management.

Additional Comments Occasional statewide travel may be required.
