Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must have one year of permanent non-competitive or 55b/c service as a Supervising Professional Conduct Investigator OR
• Ten years of experience in the investigation of complex cases leading to criminal trial and administrative proceedings (of which at least two years must have been in a leadership or supervisory capacity) which must include:
? Conducting investigations and interrogations;
? Writing reports on assignments; and
? Testifying at administrative hearings or criminal trials.

SUBSTITUTION: A Bachelor's degree in Criminal Justice, Police Science or a closely related field may be substituted for four years of the required experience. Duties Description The New York State Education Department (NYSED) is seeking to fill a Principal Professional Conduct Investigator position within the Office of Educational Policy (OEP) to assist in the management of the Office of School Personnel Review and Accountability (OSPRA). This office is responsible for preparing and prosecuting cases against teachers and school administrators who lack the moral character to hold such a credential pursuant to Education Law. It is also responsible for applying the standards of Correction Law. OSPRA also handles the administrative responsibilities associated with tenure proceedings pursuant to Education Law. The duties of this position will include, but are not limited to, the following:

• Supervise investigators in moral character cases to ensure that there is legally sufficient evidence;
• Interact with school attorneys and other school personnel on moral character, fingerprinting and tenure issues;
• Oversee the criminal history background check process, resolve the day-to day technical problems, and handle complex customer complaints;
• Supervise fingerprint processing support staff;
• Review all cases recommended for closure without action with subordinate staff to ensure that closure is the appropriate outcome taking into consideration, the conduct alleged, the legal sufficiency of the evidence, and the likelihood of prosecutorial success;
• Negotiate and oversee vendor contracts;
• Serve as liaison to vendors/agencies including court reporters, fingerprint interfaces, national educator identification clearinghouse and the Division of Criminal Justice Services;
• Assist in the management of the office, including: operations, policy, personnel decisions, trouble-shooting, customer service, and planning and decision making;
• Produce and manage office reports for fingerprint operations and investigate operations; and
• Assist in the management of the teacher tenure hearing process.

Additional Comments CONDITIONS OF EMPLOYMENT: This will be permanent, non-competitive appointment. Filling of this position is contingent upon Division of Budget approval. Promotions and transfers may change appointees’ negotiating unit. Applicants should be aware that changes in negotiating units may affect their salary, insurance, and other benefits.

*Leads to a maximum salary of $102,838 based on annual performance advances.
