Minimum Qualifications The ideal candidate will have superior legal writing and analysis skills, knowledge of workers’ compensation laws, appellate and motion practice experience in New York courts, and experience developing and managing affirmative labor-related litigation. Familiarity with communities and issues facing low-wage workers in New York State is a plus. Two (2) or more years of civil litigation and/or appellate experience is preferred.

Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the Office be citizens of the United States.


Duties Description The Labor Bureau of the Office of the New York State Attorney General is seeking an attorney to serve as an Assistant Attorney General (AAG) in its Workers’ Compensation Section in the New York City office. The Labor Bureau has been nationally recognized for aggressively enforcing labor standards throughout New York. The Labor Bureau also represents the New York State Department of Labor and Workers’ Compensation Board (“WC Board”) in certain litigation, usually involving challenges to agency determinations.

The Workers’ Compensation Section represents the WC Board and also has the authority to initiate civil investigations and enforcement actions under the Workers’ Compensation Law, which ensures that workers receive medical care and compensation for lost wages when they are injured or become ill as a direct result of their job.

The AAG’s responsibilities will primarily entail representing the WC Board in the Appellate Division, including: drafting briefs to the Appellate Division; handling motions practice, Article 78 proceedings and federal court actions involving decisions made by the WC Board; and working directly with the WC Board. The AAG will also be responsible for developing an affirmative enforcement docket involving workers’ compensation issues, including investigations of and actions against employers or insurance carriers who commit serious violations of the Workers’ Compensation Law.
