Minimum Qualifications This position requires an attorney who is exceptionally organized, detail-oriented, and able to work collaboratively. Applicants must possess excellent persuasive writing, legal analysis, research skills, substantial knowledge of the New York Rules of Civil Procedure and experience in litigating in state court with strong management skills. Applicants also must have experience with and be able to commence and direct investigations, develop strategies for moving investigations forward, and develop litigation strategies from the ground up. In addition to the qualities above, the ideal candidate will be a highly motivated individual with a demonstrated ability to jump-start investigations and litigation through identifying issues that lead to either settlement or prosecution of the claims.
Attorneys with at least ten (10) years prior experience litigating in New York courts and prior management experience are preferred. An understanding of the Martin Act and governing regulations and/or housing or real property laws and regulations, including rent stabilization, is also preferred. We are interested in applicants with relationships to stakeholders in the real estate industry, including tenant and cooperative advocates.
Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the Office be citizens of the United States.
Duties Description The Office of the New York State Attorney General (OAG) is seeking a dynamic and creative affirmative litigator with experience in housing, real estate and/or securities litigation to serve as the Enforcement Section Chief in the Real Estate Finance Bureau (REF). REF is charged with the enforcement of Article 23-A of the New York General Business Law (the “Martin Act”) and governing regulations that relate to real estate securities, including syndications and cooperative interests in realty such as cooperatives, condominiums, timeshares, homeowner associations, and syndications. REF also addresses complaints of civil frauds in real estate such as tenant harassment and problematic financing of multi-family properties.
The Bureau’s Enforcement Section investigates complaints from the public and enforces the Martin Act through the use of civil powers afforded to the Attorney General. When warranted, the Enforcement Section also cooperates with the OAG’s Criminal Division on Martin Act violations and tenant harassment violations that rise to the level of criminality.
The Enforcement Chief will be charged with overseeing the Bureau’s investigations, litigations, and settlements that involve real estate securities and also civil frauds related to harassment and the financing of multi-family properties. The Enforcement Chief will also be charged with the direct supervision of the Assistant Attorneys General of the Enforcement Section and will report directly to the Bureau Chief.
