Minimum Qualifications MINIMUM QUALIFICATIONS:
Reassignment: One year of permanent competitive or 55b/c service as a Senior Attorney.

Eligible List Appointment: Candidates who are reachable on the eligible list for this title may be considered for appointment.

§70.1 Transfer: One year of permanent competitive or 55b/c service as a Senior Attorney (Realty).

§52.6 Transfer: One year of permanent competitive or 55b/c service in a title SG-23 or above deemed eligible to transfer under §52.6 AND a Juris Doctorate degree AND be admitted to the Bar to practice law in New York State or in a state with Bar reciprocity.

Duties Description The New York State Education Department’s Office of Counsel is seeking applicants for a Senior Attorney position. The incumbent will assist in providing oral and written legal advice and services to the New York State Board of Regents, Commissioner of Education, and NYSED staff on administrative appeals, represent NYSED in proceedings, and respond to legal correspondence. Major responsibilities of this position will include, but are not limited to, the following:

• Work on procurement and fiscal issues, including: bonds, bankruptcies, contracts, and inter-agency agreements;
• Assist in the development and review of materials for competitive funding opportunities and resulting contracts;
• Review and provide legal advice regarding all manner of written agreements on behalf of NYSED, including Freedom of Information Law issues;
• Provide legal advice and counsel on issues related to the chartering and consent process for not-for-profit education corporations;
• Perform research for and draft Commissioner’s decisions in appeals brought pursuant to Education Law §310;
• Represent NYSED or assist the Office of the Attorney General in administrative and court proceedings challenging NYSED’s actions, policies, or administrative determinations;
• Perform research on legal issues as requested by the program offices or in response to inquiries from constituents; and
• Review and assist in the preparation of legislation and regulations.

Additional Comments CONDITIONS OF EMPLOYMENT: This will be a permanent appointment. Promotions and transfers may change appointee’s negotiating unit. Applicants should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Depending on qualifications, candidates may be required to serve a two-year traineeship that leads to Senior Attorney, SG-25. The salary above applies to candidates appointed to Senior Attorney, SG-25. The hiring rate for candidates appointed to Attorney 1 starts at $59,889, and for current NYS employees, is based on the candidate’s salary at the time of hire. Verification of degree and/or transcripts will be required for all candidates at the time of interview. Continued employment as a Senior Attorney is dependent upon maintaining current registration to practice law in New York State. Failure to maintain this registration will result in removal from employment.
