Minimum Qualifications This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).***

To be considered for appointment through NY HELPS, or 55 b/c, candidates must meet the open-competitive minimum qualifications for this position.

This title includes a traineeship opportunity and applicants will be appointed to the appropriate level** based on their experience and education.

**Human Resources Specialist 1 Labor Relations level requirements:
•Human Resources Specialist Trainee 1 Labor Relations (equated to SG-14): A bachelor's or higher degree.
•Human Resources Specialist Trainee 2 Labor Relations (equated to SG-16): A bachelor's degree and one year of professional labor relations experience..
•Human Resources Specialist 1 Labor Relations, SG-18: A bachelor's degree and two years of professional labor relations experience.

Substitution: a Juris Doctor, master's or higher degree in a related field can substitute for one year of specialized experience.

Dependent upon qualifications, if appointed as a trainee, successful completion of a one-year or two-year traineeship leads to appointment as a Human Resources Specialist 1, SG-18.

Applicants may also be appointed to this position if they are a current New York State employee with one year or more of permanent, contingent-permanent, or 55b/c service in a position allocated to a Grade 13 or above and eligible for transfer under Section 70.1, 70.4, or 52.6 as appropriate of the Civil Service Law.

Duties Description Human Resources Specialist 1s work in the Human Resources (HR) office within Administration & Finance. The incumbent will be assigned to the Labor Relations office within HR and will be responsible for a wide range of activities. The incumbent will be expected to learn and become proficient in bargaining unit agreements, aspects of NYS Civil Service Law, Rules and Regulations, NYS Attendance & Leave Manual, Division of Homeland Security and Emergency Services (DHSES) policies and practice, and various other NYS policies and procedures that affect employees. The incumbent may supervise lower level professional and support staff involved in HR and Labor Relations activities. Travel may be required. Possession and maintenance of a valid Driver’s License issued by the NYS Department of Motor Vehicle is required. Duties include, but are not limited to:

•Assist agency program managers and supervisors with the interpretation and implementation of NYS & DHSES policies and procedures, and bargaining unit agreements.
•Troubleshoot employee performance and conduct issues and provide technical assistance and advice to managers on corrective actions, including use of the counseling mechanism.
•Assist in the implementation of the agency’s employee disciplinary program consistent with bargaining unit agreements and Section 75 of NYS Civil Service Law. Associated duties include investigation of allegations of employee misconduct, drafting and issuing disciplinary charges, execution of settlements and representing the agency at expedited and full arbitration proceedings.
•Assist in the implementation of the employee grievance program consistent with bargaining unit agreements. Associated duties include assisting managers resolve and/or respond to first level grievances, investigating merits of the issues presented, conducting agency level meetings with union representation, authoring agency level decisions, and assisting Office of Employee Relations staff address grievances appealed beyond agency level.
•Participate in the development of training materials and curricula regarding labor-relations topics and present materials to agency staff & managers.
•Consult with DHSES Counsel’s Office and external partners on criminal matters, Equal Employment Opportunity Commission and Division of Human Rights matters, Office of the State Inspector General referrals, employee disciplinary cases, FMLA law and regulations, and Employee Health Services (EHS) requests, as necessary.
•Assist with DHSES Labor/Management and Health and Safety meetings with union representation, to include investigation and preparation of agenda items, presentation of information, follow up on action items and assistance with the negotiation and development of local Labor/Management agreements.
•Assist in the administration of the performance evaluation programs in conjunction with other offices within HR and agency program managers. Provide advice to managers in the probation and performance evaluation process, ensuring fairness and appropriate documentation. Conduct hearings on performance evaluation appeals, consistent with the NYS Office of Employee Relation guidelines.
•Administer statutory leave provisions of Civil Service Law sections 72, 72.5 and 73.
•Assist the Office of Employee Relations in gathering information and representing DHSES at improper practice hearings before the Public Employment Relations Board
•Collect & analyze data and prepare various reports and related correspondence.
•Perform additional duties as requested, including projects in support of the agency’s strategic plan.

***This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At a future date, it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in an NY HELPS title, employees may take part in any promotion examination for which they are qualified.

NOTE: Support of operations during times of emergency and disaster from State Emergency Operations Center (EOC), state field offices and/or local deployments may be required, which would result in a change and/or increase in working hours, locations and/or duties.
