Job Specifics

Minimum Qualifications Candidate must have a law degree from an accredited law school; admission to, and member in good standing of, the New York State Bar; and six years of relevant post-bar experience.

Duties Description Reporting directly to the Director of the New York State Office of Victim Services, the General Counsel’s duties include, but are not limited to:

• The General Counsel reports to the Director, functions as an integral member of the agency’s Executive Team, and provides legal guidance and services to the Director, and to other staff, on the variety of issues related to carrying out the mission of the Office of Victim Services.
• The General Counsel will monitor and review legislative and other legal changes that might impact the operation, policies, or procedures of the Office of Victim Services, including compliance with relevant state and federal law; and draft, review, and propose new legislation or legislative amendments.
• The General Counsel will provide legal advice and strategic counsel to support the Office of Victim Services including reviewing and advising on contracts, employment policies, human resources matters, and oversight of litigation.
• The General Counsel will render advice and legal opinions concerning all programs within the Office of Victim Services in support of the agency's mission to provide critical services and support to victims of crime and their families, ensuring that they are treated with the compassion and dignity they deserve.
• Specific duties will include, but are not limited to:
o Oversight and ultimate responsibility for the operations of the OVS Legal Unit and for all legal functions of the Office of Victim Services, including oversight of the Son of Sam program.
o Direct supervision of staff in the Legal Unit.
o Oversight and ultimate responsibility for all agency outside litigation, including procuring representation from the Attorney General's Office as appropriate, as well as procurement, liaison, and management of retained outside counsel.
o Direct liaison to the Office of Counsel to the Governor.
o Liaison to the General Counsels of other state agencies.
o Ensuring compliance with all applicable state and federal statutes, rules, and regulations.
o Liaison with appropriate Department of Criminal Justice Services staff to ensure the agency is properly represented in employment law related matters, human resources investigations, and related matters.
o Review and approval of all agency legislative and regulatory proposals and comment and advice on pending legislation impacting the agency, its stakeholders, and mission.
o Oversight of the appeals process for denied Victim Compensation claims in coordination with Deputy Director of Compensation.
o Serving as the agency’s Public Information, Ethics, and FOIL Records Access Officer
o Drafting, reviewing, and approving all legal or other significant agency policies, regulations, and guidance.
o Serving as the agency’s Emergency Management Coordinator, responsible for maintaining the agency’s Emergency Management Operations Protocol (EMOP) and leading the agency’s Continuity of Operations (COOP) Team.

There is the potential of 25% travel associated with this position, including overnight travel.
