Job Specifics
Duties Description Under the direction of the General Counsel of the Public Employment Relations Board (PERB), the incumbent will assist the Office of Counsel and the Board. The Office of Counsel is a modestly sized but very active litigation department.
• Represent the agency and its agents, including the Board, in New York State court actions, including CPLR Article 78 special proceedings, in various jurisdictions and venues.
• Assist the New York State Attorney General in its representation of PERB in federal court.
• Confer and correspond with outside agencies on questions of law and procedure.
• Perform legal research, create internal reports, draft motions, answers, briefs and present oral arguments as directed.
• Participate in appearances, including conferences, hearings, and arguments, in-person and/or remotely as the courts require.
• Participate in policy-making meetings and work closely with the Deputy Chair to conduct legal research and analysis.
• Draft Board decisions for review and adoption by the Board.
• Assist with rulemaking under the New York State Administrative Procedures Act.
• Respond to Freedom of Information Law requests and general inquiries.
• Travel as needed.
• Other duties as directed.
Minimum Qualifications Must be admitted to the New York State Bar and a member in good standing with a minimum of four (4) years of specialized experience in the practice of law subsequent to admission. Specialized experience is defined as civil practice litigation experience in New York state court, Taylor Law knowledge, and/or private sector labor law knowledge (i.e., the New York State Employment Relations Act and/or the National Labor Relations Act). PERB will consider candidates with appropriate post-bar experience and bar admission in a state with reciprocity with NYS. Candidates with bar admission in another state must obtain NYS bar admission prior to their hire date.
