Job Specifics
Duties Description Under the general supervision of the Director and Counsel for Investigations in the Anti- Discrimination Investigations Unit (ADID) of the Office of Employee Relations (OER), the Assistant Director performs legal duties associated with workforce development issues.
Duties include but are not limited to:
• Research and analyze legal and factual issues in order to review and prepare draft reports.
• Confer with and advise the Director and Counsel for Investigations on pending administrative procedures, civil litigation in state and federal courts, appeals, investigations and other administrative matters.
• Guide Affirmative Action and Labor Relations staff on legal questions and on preparation of draft investigation reports.
• Organize large volumes of factual and legal data into clear and logical sequences.
• Analyze legal issues and identify significant precedents, cases, opinions, and facts from federal and state cases nationwide.
• Present, orally and in written form, the legal basis for a specific action or point of view.
• Discuss legal issues with agency policymakers and other attorneys to convince others of a particular point of view by means of thorough case presentation and skilled logical thinking.
• Prepare detailed, accurate and convincing legal memoranda, accompanied by appropriate citations, in support of actions taken by program staff.
• Provide continuous legal consultation to Director and Counsel for Investigations.
• Recommend changes in rules, regulations, policy statements, etc. to take into account new legislation and court decisions.
• Research, monitor and brief discrimination cases for which there is little precedent and/or that could have a significant impact on the program.
• Significant oversight responsibility for the work of ADID investigative teams.
Minimum Qualifications • Admission to the New York State Bar and four years of experience in the practice of law subsequent to admission to the Bar.
• Experience as an attorney working on matters dealing with federal and/or state employment law, labor relations, civil rights litigation and/or government organization.
• Excellent oral communication, interpersonal, and advanced writing and editing skills.
• A satisfactory equivalent combination of appropriate experience and education as determined by the NYS Office of Employee Relations.
Additional Comments Work Hours and Telecommuting will be discussed during the interview.
