Job Specifics
  Duties Description Under the general direction of an Associate Attorney within the Office of General Services (“OGS”), the Senior Attorney will provide legal assistance to support various agency functions with a focus on the leasing of private property for State purposes and State property to private tenants, and other legal matters and special projects.
Duties include, but are not limited to:
•	Assists, through an Associate Attorney, with the negotiation, drafting, and review of (i) leases and permits with private entities for occupancy by State agencies and (ii) leases and permits for the use of State retail property by private tenants and provides other support as necessary to Leasing Services.
•	Provides advice to Leasing Services on a variety of administrative matters, including but not limited to assignments, estoppels, Subordination, Non-Disturbance and Attornment agreements, and set offs.
•	Assists, through an Associate Attorney, the Franchise Oversight Board in matters relating to the oversight and administration of operations at the State’s three racetracks.
•	Assists, through an Associate Attorney, in matters relating to OGS’s representation on the 110 State Street Board of Managers.
•	Consults with and secures approval, when necessary, of the State’s control agencies, including the Office of the Attorney General and the Office of the State Comptroller, for a wide variety of OGS leasing transactions.  Assures compliance with the Procurement Lobbying Law and the vendor responsibility requirements under State law and guidelines of the Office of the State Comptroller.
•	Furnishes, through an Associate Attorney, to OGS senior staff, professional evaluation, legal research, and advice regarding leasing matters.
•	Represents and participates, with an Associate Attorney and senior staff, in internal and external conferences and meetings involving leasing matters with State agencies, local governments, and private sector entities.  Such representation and participation may vary in length and degree of formality but shall require thorough preparation and skilled assessments supported by research.
•	Where necessary, assists senior staff and the Office of the Attorney General in the evaluation of and response to claims pertaining to leasing matters against the State or OGS and the development of appropriate defenses to such claims.
•	Provides legal support and counsel on leasing services, and general legal issues affecting agency administration, including the drafting of legal opinions and memoranda as assigned by the Counsel, senior legal staff, and business unit administrators.
•	When requested to do so by the Deputy Counsel or the Counsel, assists the Division of Real Estate in the preparation and review of OGS legislative proposals and State agency legislative proposals relating to leasing services.
•	Performs other duties as assigned by the Counsel, the Deputy Counsel, the Supervising Attorneys, or the Associate Attorneys.
Notes:
*There is no examination required for appointment to a NY HELPS position. Candidates hired before May 2024 will be appointed on a temporary basis. In May 2024, satisfactory employees will receive permanent, non-competitive appointments and will begin a probationary period.
At a future date (within one year of permanent appointment), it is expected that NY HELPS employees will have their non-competitive employment status converted to competitive status, without having to take an exam. Employees will then be afforded with all the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified. 
  Minimum Qualifications This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS)* and applicants must meet the following minimum qualifications to be considered for this position:
 
This title includes a traineeship opportunity and applicants will be appointed to the appropriate level** based on experience.
 
Required experience: qualifying legal experience includes applicable experience earned post-NYS Bar Admission.
 
**Senior Attorney level requirements:
• Assistant Attorney 1 (equated to SG-18): Law school graduation and/or eligibility for NYS Bar Admission, and no qualifying post-Bar experience.
• Assistant Attorney 2 (equated to SG-20): Admission to NYS Bar and less than 12 months of qualifying post-Bar legal experience.
• Assistant Attorney 3 (equated to SG-22): Admission to NYS Bar and less than 24 months of qualifying post-Bar legal experience.
• Senior Attorney (SG-25): Admission to NYS Bar and two years of qualifying post-Bar legal experience.
 
Applicants may be appointed to this position if you are a current New York State employee with one year or more of qualifying permanent service in a position allocated to a Grade 23 or above and eligible for transfer under Section 52.6 or 70.1 of the Civil Service Law AND possess a Juris Doctorate degree, have good standing with NYS Bar admission, and two-years of post-bar experience.
