Job Specifics
Duties Description Under the general direction of an Associate Director of Human Resources, G-27, a Human Resources Specialist 2 (Labor Relations) will complete the following duties, including but not limited to:
• Supervising Human Resources Specialist 1 (Labor Relations) staff in the Labor Relations office. The incumbent will train, guide and mentor staff knowledge and abilities, evaluate their performance and training needs; assign and manage assignments and travel; review work of staff while in progress to evaluate need for adjustments; perform the first level review of work completed by staff (Notices of Discipline, Settlements, Grievance Decisions, Database development, etc.); and guide and assist staff in preparing for arbitrations and grievance hearings.
• Providing technical advice and assistance to management regarding the interpretation and application of negotiated agreements, Civil Service Law, Department policies and procedures. Assisting in counseling employees and analyzing employee time records to identify attendance issues.
• Conducting disciplinary investigations, interviewing witnesses, gathering evidence, reviewing applicable policies and documents, consulting with supervisors and managers, conducting interrogations, writing Notices of Discipline and proposing penalties. Preparing draft settlements, reviewing and discussing settlements with management and unions, conducting Agency Level Meetings.
• Representing Department at CSEA Time and Attendance Hearings, CSEA Expedited Resolution Meetings, Article 33 Arbitrations and Section 75 Hearings. Preparing witnesses to testify, preparing evidence and case, conducting direct examination and cross-examination of witnesses, writing Closing Briefs.
• Assisting managers with Step One grievance hearings and decisions, conducting Step Two grievance hearings and drafts decisions, providing supporting documentation and information to GOER for Step Three grievances.
• Facilitating the discussion and resolution of labor/management issues through both informal discussions and formal committees.
• Managing issues of employee health and safety, such as the Prevention of Violence in the Workplace law, NYS Public Employee Safety and Health Act, as well as informal complaints and issues forwarded by managers, unions and employees.
• Conducting supervisor training in Labor Relations matters, such as counseling and discipline for work performance, attendance and behavior issues; the disciplinary process; and grievances.

Minimum Qualifications To be eligible for this position, you must meet one of the following conditions:
1. Eligible for appointment from the Human Resources Specialist 2 (Labor Relations), G-23 eligible list.
2. In a Human Resources Specialist 2 (Labor Relations), G-23 title eligible for reassignment
3. In a G-21 or higher title that meets criteria for 70.1 or 52.6 transfer
4. For provisional appointment*: One year of permanent competitive or 55b/c service as Human Resources Specialist 1 (Labor Relations) or Human Resources Specialist 1.
5. For NCP appointment**: One year of permanent competitive or 55b/c service as Human Resources Specialist 1 (Labor Relations) or Human Resources Specialist 1.
The Division of Personnel anticipates the possibility of making an appointment in the near future to this title. Section 52.7 of Civil Service Law allows an agency to nominate a candidate for a non-competitive promotion examination when there are three or fewer qualified candidates in the departmental promotion field interested in competing in an examination to fill a position. The following position is being posted to determine if there is a promotion field and/or if a non-competitive examination is appropriate in accordance with Section 52.7.
*A provisional appointment is authorized by §65 of the Civil Service Law when there are fewer than three list eligibles willing to accept appointment to the position. In order to be provisionally appointed to the posted title, the candidate must meet the minimum qualifications as specified above. If offered a provisional appointment to the position, the candidate must take the next examination to be held for this title and be reachable on the subsequent established eligible list.
**An NCP appointment may be allowed if there are three or fewer qualified candidates in the promotion field interested in the position.
Additional Comments Hours of the position will be discussed at the time of interview, including questions regarding Flextime, AWS/Compressed work week and Telecommuting.
