Job Specifics

Duties Description Under the general supervision of the General Counsel, the incumbent will:

Represent the agency and its agents, including the Board, in New York State court actions. This includes CPLR Article 78 special proceedings in various jurisdictions and venues. May also initiate court proceedings on behalf of the Board, including applications for injunctive relief, and enforcement and contempt proceedings.

Assist the New York State Attorney General in its representation of PERB in federal court.

Conduct or assist in investigation of charges of illegal employee strikes against public employers and prosecutes those charges which are warranted.

Review applications for injunctive relief filed under CSL 209-a.4 and, where appropriate, makes applications to the court for such relief.

Monitor local government procedures under CSL 212 on a regular basis and brings such proceedings as may be necessary to ensure compliance. Also advise local government officers about PERB’s rules, regulations and policies.

Initiate such proceedings and take such other steps as are necessary to enforce the orders of the Board.

Prepare and disseminate legal interpretations of statutes, rules, regulations and decisions for the Board, state agencies, local units of government, employee organizations and other interested parties.

May assist Deputy Chair in drafting or analyzing legislation, memoranda or Board decisions.

Other duties as assigned.

Minimum Qualifications Admission to the New York State Bar and a member in good standing, and six years of subsequent specialized experience.

Specialized experience is defined as civil practice litigation experience in New York State Court, Taylor Law knowledge, and/or private sector labor law knowledge (i.e., the New York State Employment Relations Act and/or the National Labor Relations Act).

PERB will consider candidates with appropriate experience and bar admission in a state with reciprocity with NYS. Candidates with bar admission in another state must obtain NYS bar admission prior to their hire date.
