Duties Description The New York State Education Department’s Office of Education Policy is seeking candidates for the position of Education Program Manager 1 in the Federal Grants Office. The incumbent of this position will lead the Office of IDEA Programs under the supervision of the Assistant Commissioner. This team is responsible for the implementation of fiscal administration and oversight of programs funded under the federal Individuals with Disabilities Education Act (IDEA). The fundamental core of the work in the Office of IDEA Programs is to oversee New York State’s fiscal administration of the federal grants relating to Part B of the IDEA to ensure funds are distributed and expended in accordance with federal fiscal requirements. New York State's fiscal management system relating to the IDEA grants includes documentation of required budgetary information, and fiscal policies and procedures reflecting the IDEA statute and regulations which assist states in using federal funds for improving performance and outcomes for students with disabilities and ensure that students with disabilities receive a free appropriate public education (FAPE) that meets their unique needs in an educational environment that enables them to be educated alongside their peers without disabilities to the maximum extent appropriate. Duties of this position include, but are not limited to, the following:
• Direct and manage New York State's administration of over $800 million in IDEA funds allocated to local educational agencies (LEAs) in accordance with the IDEA statute and regulations to ensure compliance with applicable federal grant requirements and that performance expectations are being achieved;
• Direct and administer the New York State IDEA grant application and LEA IDEA grant application and all required components, including but not limited to required federal assurances and certifications, General Education Provision Act (GEPA) requirements, maintenance of effort provisions, certification of funding for approved special education providers, Comprehensive Coordinated Early Intervening Services (CCEIS) and Voluntary Coordinated Early Intervening Services (CEIS), and required provisions relating to parentally-placed students in nonpublic schools;
• Develop and oversee fiscal components of New York’s general supervision system of the IDEA, including policies and procedures, for subrecipient monitoring, subrecipient risk of noncompliance, terms and conditions of subawards, fiscal management consistent with federal regulations and other federal requirements under the IDEA grant including but not limited to correcting calculating the proportionate share for parentally-placed private school children with disabilities ages three through five for IDEA Section 619 and three through 21 for IDEA Section 611;
• Establish effective internal controls to provide reasonable assurance for New York’s management of the IDEA awards and grants in compliance with applicable federal statutes, regulations, and the terms and conditions of the IDEA Part B award;
• Establish a mechanism for ensuring the correction of noncompliance identified in a management decision letter to determine whether an auditee has completed all required corrective action;
• Fulfill roles and responsibility, as applicable, in interagency agreements, budget, data, audit, and program office collaborations, and participation in technical assistance opportunities relating to fiscal oversight of federal funds, issuing IDEA allocations, release of funds, and reallocation considerations;
• Provide leadership and support for the development and implementation of the team's technical assistance plan, including generation of field guidance documents, in-person workshops, webinars, office hours opportunities, and one-on-one supports on topics related to IDEA fiscal requirements, annual applications/plans, budgets, fiscal monitoring and enforcement, reallocation of funds and other topics as identified and required by the IDEA and applicable regulations;
• Inform and participate in meetings of the Commissioner’s Advisory Panel on Special Education Services to provide information and receive feedback on Department and Office priorities and functions;
• Manage the coordination and submission of documentation for the Department’s federal single audit;
• Coordinate and collaborate with the Department’s Office of Special Education, Office of State Assessment, Rate Setting and STAC/Medicaid Units, and other Department offices as applicable, regarding contracts and agreements with third-party vendors;
• Serve as the State IDEA fiscal liaison to the United States Department of Education (USDE), and collaborating with national partners including the Council of Chief State School Officers and other state leaders to ensure effective fiscal administration, oversight, monitoring, and compliance with federal IDEA regulations;
• Initiate the coordination of activities for collecting and reporting out of IDEA program and fiscal data; and
• Direct the work of 2 Supervisory staff, 10 professionals, and clerical staff.
Minimum Qualifications MINIMUM QUALIFICATIONS:
Reassignment: Candidates must have one year of permanent competitive or 55b/c service as an Education Program Manager 1.
Section 52.6 Transfer: Candidates must have one year of permanent competitive or 55b/c service in a title allocated M-3 or higher eligible to transfer under Section 52.6 of the Civil Service Law.

Provisional Appointment: In the absence of an eligible list with three or more candidates willing to accept a position, a temporary provisional appointment may be considered. For provisional appointment, candidates must be a current New York State Education Department employee AND have one year of permanent service as a Supervisor Education Programs, Supervisor Education of Children with Disabilities, Supervisor Educational Testing, Supervisor Higher Education Programs, Supervisor of Occupational Education, Supervisor of Professional Education Programs, Supervisor School Improvement Planning or Supervisor School Business Management OR two years of permanent service as an Associate in Instructional Services (any specialty area), Associate in Educational Planning and Evaluation, Associate in School Nursing, Associate in Education Improvement Services, Associate in Bilingual Education, Associate in Education Research, Associate in School Business Management, Associate in Continuing Education, Associate in Education of Children with Disabilities, Associate in Education Improvement Services, Associate in Educational Testing, Associate in Higher Education Opportunity, Associate in Higher Education, Associate in Intercultural Relations, Associate in Nursing Education, Associate in Nursing Education (Addictions), Associate in Occupational School Supervision, Associate in Professional Education, Associate in School Library Service and Associate in Teacher Education. Provisional candidates must take the examination for Education Program Manager 1 when it is next offered, and must be reachable on the resulting eligible list to maintain employment.

This will be a permanent appointment or a temporary provisional appointment. Provisional candidates must take the examination for Education Program Manager 1 when it is next offered and must be reachable on the resulting eligible list to maintain employment. Promotions and transfers may change appointees’ negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. This position allows for the opportunity to telecommute up to 30% each bi-weekly pay period and is granted at the discretion of the supervisor and the appointing office. This position will require 10% in-state/Statewide travel. Federal law may impose additional requirements or restrictions regarding positions that receive federal funding.
This position leads to a maximum salary of $160,911 based on annual performance advances. For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.
